The NFL and the Cleveland Browns are reviewing the charges against wide receiver Donte Stallworth, who is accused of killing a pedestrian while driving his Bentley drunk after a night out at a posh South Beach hotel.

Stallworth was expected to surrender in court Thursday morning to face charges of DUI manslaughter in the March 14 accident that killed 59-year-old Mario Reyes. If convicted, Stallworth would face up to 15 years in prison. A warrant for the 28-year-old’s arrest was filed Wednesday and prosecutors said they will ask that he be released on $200,000 bail.

Stallworth’s blood-alcohol level after the crash was .126, well above Florida’s legal limit of .08, according to results of a blood test. Stallworth will also be charged with DUI, which carries a possible six-month sentence plus fines and community service for first offenders.

“Whenever a deadly accident occurs and a driver is impaired, families suffer,” said Miami-Dade State Attorney Katherine Fernandez Rundle in a statement.

Stallworth released a statement last month saying he was “grief-stricken” over the accident.

The Browns said in a statement that they were “disappointed” that Stallworth put himself in this position.

“We are saddened by the circumstances that have taken place and our thoughts and prayers go out to the family of Mario Reyes,” the statement said. “We have been in communication with the commissioner, who is reviewing the situation under league policies, and we will withhold further comment at this time.”

NFL spokesman Greg Aiello said the league would review the case under its conduct and substance abuse policies.

“As the state attorney has said, this was a tragic accident that raises serious issues and we join all those who have expressed their sympathies to the Reyes family,” Aiello said.

Stallworth will be prohibited from driving while on bail and not allowed to drink alcohol, according to court documents. He also must observe a midnight to 6 a.m. curfew and submit to random alcohol and drug testing through the NFL’s substance abuse program.

A Miami Beach police report said Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the black 2005 Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift around 7:15 a.m.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40 mph zone.

An additional police affidavit filed Wednesday said that on the morning of the crash, Stallworth was drinking at a club in the posh Fontainebleau hotel on South Beach. He left to go to a nearby home — it’s not clear if it was one of his three Miami-area properties — and then headed out to the causeway where Reyes was struck.

“I hit the man lying in the road,” Stallworth told officers arriving to investigate the crash, according to the affidavit. One officer smelled alcohol on Stallworth’s breath and said that his eyes appeared bloodshot and watery.

Stallworth’s attorney Christopher Lyons did not immediately return a telephone call seeking comment.

Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans.

    The NFL players are getting hotter and hotter each year. No, I’m not refferin to their looks, but the problems they get themselves into are increasing like crazy. Just goes to show all you people who put them above everybody else, that these men are just like everyone else.. except they have millions more dollars than the average. i dont know whats gonna happen with this man, but I hope they learn their lessons and I hope Mr. Reyes family is going to be fine also. But of course they will. We all know that this will lead to a billion dollar lawsuit against Stallworth and his football career willbe in the bag on its way to Mexico.

    It is so sad to say but its the truth. Professional athletes are getting out of control. Maybe its because they think the world revolves around them. Somebody needs to make them more responsible because you are not invincible. Yal are human just like the rest of us. The only difference is you get to run round on a field or court chasing a ball and get paid alot of money for it. Its just a game remember that real life still goes on when you leave from playing the game.

    It is so sad that most of these athletes think that they are above the law. Furthermore I really hate that it seems to be all of the black athletes that are acting a fool. I wish they would just make their money and go sit down somewhere! He just destroyed someones family, his family, and his career! Its so sad and disappointing.

    The sad thing is that this will not get anywhere near the publicity of Vick;s case. He’ll get about 6 months of prison time and be playing in the NFL in know time. Sad that society values animals over humans.

    This is a sad situation for the family of the man who was killed. I have no sympathy for Stallworth. MO FO you are rich! Call a car service, seriously.. he was over twice the legal limit, drunk as a skunk. I think the problem is that these athletes need to be taught some life skills. They need classes in budgeting, responsibility and life skills. I know it sounds corny but if something doesn’t change we are going to see the same stupid ish over and over again, athletes who are capable of great acheivements throwing it all away.

    Let him be tried in a court of law not the court of public opinion. From what I’ve read, the victim was not in the crosswalk and Stallworth flashed his lights and blew the horn before the accident. This accident could have happened to anyone sober, drunk, driving while talking on a cell phone ect… I’m sure his layers will get him a good deal plus he will probably pay a substantial settlement to the victim’s family for their loss. Dude was a good guy, never in any trouble from what I know of. Accidents happen.

From the looks of these football players, they are being treating like any other black person in America. Bottom line is that he was wrong but also when someone white does this same thing, that person(s) should get the same sentence as Dontae Stallworth will receive.

    I don’t understand why people with so much money do the dumbest things ever. Then when they do it they think that they are untouchable. You may have fame and money, but the reality of the fact is that you’re still a civilian in the USA. Which means that laws do apply to you just like they apply to everyone else.

    This is so sad! I think he should get the max sentence. THINK IF THIS WERE YOUR FATHER HE’D RUN OVER!!! If this was just me or anyone of you, we’d be getting the book thrown @ us. But ITA with whomever said the Black atheletes/celebs are getting harsher punishment than their White counterparts….BUT then again…THAT HAPPENS ALL DAY EVERY DAY TO REGULAR BLACK PEOPLE VS. REGULAR WHITE PEOPLE…..so it’s really no surprise :-(

    Athletes have been out of control, it is now just getting awareness. Before people were patting them on the shoulder and saying “You made a mistake and now promise you will never do it again and it will all go away”. Many think they are above the law as well as above human society. Athletes need to be humbled nowadays. Athletes make tons of money and other perks doing something that you love. You should be counting your blessings. This was a reckless act and need to be handled according. “Accidents happen”? Please, that is crazy. What if that was your loved one hit? People stop pulling the race card. It has gotten old and is useless. To God Be The Glory.

    Plain and simple this guy needs to be in prison for about 20 years. The family should be paid a couple of millions for pain and suffering. It’s a slap in the face to say he’s grieving for the family F you dude if that was my father. I use to drink and drive until I got a DUI and that was probably the best day in my life because it woke me up. I lost my license, my car got repoed, they sold it at a auction and I had to make up the difference (7000 dollars). I lost my girlfriend the one who told me to come pick her up even though she knew I was sloppy drunk. I had to take AA meetings, pay 5000 dollars in lawyer fees, pay extra on my insurance and my credit was ruined for 7 years and I’m glad it happened. It could have all be different, I could have killed someone. I learned my lesson and don’t drink and drive. This guy needs to go to prison for a very long time, I don’t want to hear about he made a mistake. No one gets caught drinking and driving their first time. I had someone tell me if you drink and drive when you get caught it will make up for all those other times you got away. Welcome to reality dude.

    Why does everything have to be black and white he killed a man and he should be punished. If Micheal Vick were white he would have got the same punishment. America is a country of dog lovers and they made an example of him. I love my dog almost like a son and when I saw some of the pics at his home it made me sick. We all know the justice system is messed up and a lot more black people get the crappy end of the stick but this is murder. I didn’t come from much but now I have a great family a nice home and a great life. I’ve never sold drugs or lived the thug life and I think the military helped me with that. I’ve been drunk and I’ve seen people drunk and it slows your reaction time. If he didn’t hit him on a sidewalk what did he do drive up on a sidewalk and kill him. No excuses you drive drunk you pay the price. It will be very interesting what happens to him but I think his NFL career is done because the new commisioner doesn’t play around.
