This company’s reprehensible behavior underscores the need for substantive health care reform in this country. In May, 2002, Jerome Mitchell, a 17-year old college freshman from rural South Carolina, learned he had contracted HIV. The news, of course, was devastating, but Mitchell believed that he had one thing going for him: On his own initiative, in anticipation of his first year in college, he had purchased his own health insurance.

Shortly after his diagnosis, however, his insurance company, Fortis, revoked his policy. Mitchell was told that without further treatment his HIV would become full-blown AIDS within a year or two and he would most likely die within two years after that.

So he hired an attorney — not because he wanted to sue anyone; on the contrary, the shy African-American teenager expected his insurance was canceled by mistake and would be reinstated once he set the company straight.

But Fortis, now known as Assurant Health, ignored his attorney’s letters, as they had earlier inquiries from a case worker at a local clinic who was helping him. So Mitchell sued.

In 2004, a jury in Florence County, South Carolina, ordered Assurant Health, part of Assurant Inc, to pay Mitchell $15 million for wrongly revoking his heath insurance policy.

In September 2009, the South Carolina Supreme Court upheld the lower court’s verdict, although the court reduced the amount to be paid him to $10 million.

    When it comes to conflicts of interests, he who usually causes it wins it every time :-) The health insurer had no incentive to settle the conflict in the patient’s favor.

    That was a dumb thing to do to the guy. ON the other hand, there needs to be a damn law that stops people from getting this rich off of the stupidity too!

    On another note, that boy is likely never going to make 10mil over his lifetime, even less likely since he has this disease, so that’s an outrageous sum to award to someone. So while I agree that it was wrong what they did to him, he also shouldn’t have received that much money.

    this country really was stolen,and started by criminals, anytime you,re willing to let people die to save and make money ,america really need to stop lying about how bad other country treat their citizens and, look at their damn self because, america is damn sure not a big bucket of fun this country is more full of s**t then any other country around,all these other countries who they say are not as wealthy as america, yet they can affort to give their citizen free health care americans have always been some evils devils, that always point a bad finger at everybody else,america is guilty of human right violations,health care is a right not a option centered around how much money you have to pay for it ,americans are breaded to think real stupid they always look at life from a thuggish hard core out look.

    And the robbery will not cease, EVER! Our version of capitalism is about exploiting someone, for the gain of another. We make up ways to legally craft ponzi schemes on other entities, and billions are gained by a few, and lost by a great many. It’s all schemes, lies and tricks, that’s why they can’t make any changes, because it would crumble a whole foundation made on inter-woven lies and cheats. One industry helps the other. Keep us sick, by the Food industry, who gets to lie on food labels or omit ingredients, and get to set their own “HEALTHY CHOICE” labels on their products because our government said they can police themselves with their products, when in fact their stuff is NOT healthy. We feed into the wall street, whether it’s our banking, homes, food or health. There is almost no aspect of our lives that isn’t connected to crooked firms now. And now, with this disgusting health care system we have, it’s inspiring even doctors to be cheats! They’re making up sh1t on my physical exams and doctor visits, just to get extra money, hoping that i don’t check my medical statements. I dropped my doctor because of that bulls**t! Asshole told me I had a heart murmur because he wanted to charge me over 1,000 to hook me up to some old ass machine he had to take my pulse, rather than qualified nurse or himself doing my stats. WTF? Dude was ready to take me through a whole course of meds and nonsense. I put a stop to that crap quick! Went to a new doc and he said there are no goddamn signs of that crap!
    Now the docs want to do concierge service, and charge high fees to get “elite” health care. So wtf am I getting with my HMO if doctors are promising the best health care through their own setups that don’t use HMOs anymore? Very unethical practices now by doctors. I’m telling you, crooks, all of them!
