Medical Marijuana
WASHINGTON — Marijuana-smoking patients or their sanctioned suppliers should not be targeted for U.S. prosecution in states that allow medical use of the drug, prosecutors were told Monday in a new policy memo issued by the Justice Department.

Under the policy spelled out in a three-page legal memo, federal prosecutors are being told it is not a good use of their time to arrest people who use or provide medical marijuana in strict compliance with state law.

The guidelines being issued by the department do, however, make it clear that federal agents will go after people whose marijuana distribution goes beyond what is permitted under state law or use medical marijuana as a cover for other crimes.

The memo advises prosecutors they “should not focus federal resources in your states on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana.”

The new policy is a significant departure from the Bush administration, which insisted it would continue to enforce federal anti-pot laws regardless of state codes.

“It will not be a priority to use federal resources to prosecute patients with serious illnesses or their caregivers who are complying with state laws on medical marijuana, but we will not tolerate drug traffickers who hide behind claims of compliance with state law to mask activities that are clearly illegal,” Attorney General Eric Holder said in a statement.

Fourteen states allow some use of marijuana for medical purposes, among them California.

California stands out for the widespread presence of dispensaries — businesses that sell marijuana and even advertise their services. Colorado also has several dispensaries, and Rhode Island and New Mexico are in the process of licensing providers, according to the Marijuana Policy Project, a group that promotes the decriminalization of marijuana use.

Holder said in March that he wanted federal law enforcement officials to pursue those who violate both federal and state law, but it has not been clear how that goal would be put into practice.

The memo spelling out the policy was sent Monday to federal prosecutors in the 14 states, and also to top officials at the FBI and Drug Enforcement Administration.

The memo written by Deputy Attorney General David Ogden emphasizes that prosecutors have wide discretion in choosing which cases to pursue, and says it is not a good use of federal manpower to prosecute those who are without a doubt in compliance with state law.

“This is a major step forward,” said Bruce Mirken, communications director for the Marijuana Policy Project. “This change in policy moves the federal government dramatically toward respecting scientific and practical reality.”

At the same time, officials said, the government will still prosecute those who use medical marijuana as a cover for other illegal activity.

In particular, the memo urges prosecutors to pursue marijuana cases which involve violence, the illegal use of firearms, selling the drug to minors, money laundering or involvement in other crimes.

    In my opinion, marijuana will eventually be legalized. The door has already been open with state rights. It is only a matter of time. Mind you, some states will be a little more restrictive but eventually, it will happen. Up until now, the only thing holding up the legalization process is our law enforcement. Legalizing petty narcotics will put alot of people in the “LEA’s” out of work. Probation officers, police, clerks for the courts and so on. I mean who is really a threat, a smoked out kid just hanging out at home or some pervert that screws with little kids. Now, that being said, I do not mess with illegal drugs. I did the college thing but basically, it never was my thing. I have always supported the legalizing of weed all my life because it is no freakin danger to our society. The only thing is you will have alot of black and brown people out of jail and off paper. What are the bigots gonna do then. Think a black man will be elected president.

    i ‘heard’ that back in the day when the country was all f^cked up during the great depression, they got rid of Prohibition’s ban on alcohol and made it legal again under the rule of Franklin Delanor Roosevelt(FDR) and the New Deal….

    was this to calm the masses down???

    Well I’m just hoping and praying that it is not so legal as to offend the others who do not indulge in it. I am allergic to it and break out in hives and have major trouble breathing. So legalizing it for public use (if that ever happens ) might actually kill a person or other people like me.
    A lot of people think that just because its natural , it’s ok. I disagree completely. It does harm to a lot of people. There are reports that some people who actually DO use it for medical reasons (so they say) only get about 30 minutes of satisfaction from it. And what that means is that they have to keep on using and end upon somebody’s couch stoned out all day and night. Who in the hell wants to be a vegetable?!?
    Things that make you go..hmmmmmmmmmmmmmmmmm!

    SoularFlarez, I agree with you on that perspective that it creates many limitations for people using it to think outside of the box. However in adding to that, there are a lot of people (mentally challenged as an example)..who need to think outside of the box because the way that they think is not balanced.
    It frightens me to think that a lot of people who do actually use it as a form of entertainment, do not realize that they are going to another form or fashion of thinking and temporarily doing things. To them, it is just a high, a good feeling..but to what exactly? What you are running from when your high is over will still be waiting for you when you come down from it and what you felt when you were in the moment is only temporary…did you remember telling that loved one that you hated them when you were in your OTHER zone?
    Hmph…

    Legalizing it for public use would be great, and missstrings you wont die weed isn’t harmful at all, I know people with asthma who smoke weed no lie! Yea I said it look up why it was made illegal, definitely not because its lethal. There has not been one death from someone smoking marijuana and that’s because it is not a lethal drug, the closest thing that will happen when your high is you will act a little crazy and that’s only some people i can keep my cool when im high but you wont be stupid enough to get high and play with a gun like them old commercials say that’s just media being put to work to f**k up your thinking on the drug.
