OPINION: How We Can Work Toward Justice For Heather Ellis

In case you’ve been under a rock for the past three weeks, Heather Ellis is the 24-year old black college student now facing 15-years in prison after being accused of cutting in line at Walmart.  Of course, she was not charged for cutting in line, but the Walmart clerk refused to serve her because she accused her of cutting the line, which led to an argument resulting in the police being called.  Some how, this pastor’s daughter with no criminal record is now being charged with two felony counts of assaulting a police officer.  The truth, however, is that even based on the officer’s own accounts, there does not appear to have been anything that occurred in that store which justifies taking this young woman’s future.

As a result, Heather has been unable to go to medical school and has spent three years fighting the charges.   Here are the latest updates on her case:

1)    We are going to Kennett, Missouri in a national rally set to take place on the court house steps on November 16 at 11 am.  We are going to demand that Heather be freed and that the United States Justice Department do a full investigation of the judicial system in Kennett, Missouri.

2)    The prosecutor in the case, Stephen Sokoloff, has voluntarily stepped down, citing our public pressure as part of the reason he is leaving.   The truth, however, is that we are incredibly suspicious of this move, and not sure if this is a good or bad thing for Heather.  The justice system in this area does not appear to be credible when it comes to how it treats black people.

RELATED: OPINION: Why Black Students Must Stand Up For Heather Ellis

3)    The new prosecutor, Morley Swingle, wrote a book with a Confederate Flag on the cover.  That is not a good sign when it comes to showing any form of sensitivity for people of color.

4)    The Justice Department of Missouri has been called in for our protection during our rally, since they have reason to believe that the environment is going to be quite hostile and possibly violent.  We are going to march anyway.

5)    Many across the country are finding ways to hold Walmart accountable.  I am not calling for a boycott, but on the website for the case, I am asking that supporters of Heather’s cause use our form letters to write to Walmart to ask for their assistance in helping this young woman.  A call from the right Walmart executive could probably make this all go away.  Instead, Walmart has simply changed its email addresses in response to the thousands of letters and emails they are receiving in support of Heather Ellis.  So far, I am disappointed in their reaction.

6)    We are also concerned about the case of Walter Currie, a 15-year old kid in nearby Poplar Bluff, who was sprayed with gasoline and set on fire by one of his white classmates.  According to Walter’s mother, the child has been put in separate classes from the other kids, since they were told that his appearance would be disturbing to the students in his class.  This is the mindset of the place we are going to on Monday.  If you can spare a moment, we can use all the help we can get.

This is crazy as hell. This happened to me in a Wal-Mart. Mexican woman just jumps in front of me and played like her fool butt couldn’t speak English. So when I said something to the cashier, she said it was Wal-Mart’s policy not to get involved and proceeded to check the woman out.

Fortunately, she was still in the parking lot and I had my police friend run her tags. Let’s say, she’s back in Mexico where she belongs! As far as Wal-Mart, I wrote a letter to their corporate office. Their response? Two three-sentence paragraphs offering their apology.

    ME = **blank_stare**

This will NOT end well or in her favor.

What’s wrong with a book that has the confederate flag? It is a part of history and when used properly is very appropriate. I have one hanging in my house right now.

Ivan, I understand you are trying to making a point, I just don’t undrstand what point you were trying to make. I’m sorry, but you lost me at the beginning. The “guy” young man that is doing 25 years for shooting at the police although, this is the first time I have heard this story it is wrong if he shot at the police, and I don’t care what color the police was, or he is because Wrong is Wrong.. As for the book with the confederate flag, I would say one would assume, but if I may recall there was a question asked should we be concerned? As for the 15 year old boy that was set on fire, that whole entire situation is very disturbing. It is very disturbing to know that High School students have that kind of hate to set another human on fire and rant the words as he burned “burn n****r burn”. Ivan yes what gives? The incident with Walmart did start by being accused of cutting a line, and now trying to recan their story, yes what gives? I don’t understand how mere facts are the same as bias. Maybe I lost the true meaning of the two words, but I will also inform you for one to know what we are dealing with and to listen to an outsider who is being biased and not knowing the facts. What Gives?? Maybe the fact that Barak Obama is the President and we have come a long way and some of us still have a long way to go. What Gives?? The fact that black people need to stop finding all the wrong in each other and look for the wrong in no matter who it is in. What Gives?? Hmm, maybe the fact that just because there are no problems in your area does not mean there are not in mine. What Gives?? The fact that being wrong no matter who you are or who you represent is wrong. What Gives?? The fact that we would rather kill our own and hold up for the other, just because they said it and if they said it then it is the truth. Yes Ivan What Gives?? I Love all of God’s people and if they are wrong, then they are wrong, but I will fight for right and it does not matter who or what it is. That’s why I am fighting for JUSTICE in this area of Ellis and Currie, see you don’t live in this area and have no clue what the situation is, now I just gave. God Bless and Just Pray for Right and Justice and we should be OK. Love Ya and Peace.

Speaking of bias, how much bias can be written into this blog…..

    Black Woman Faces 15 Years in Prison for Cutting Line at Wal-Mart;

Let’s see, I know this guy who is doing 25 years for shooting at the police…one of them black. It all started when he decided not to pay child support. Then his license were suspended, then he was being pulled over…so he decided to outrun a black police…a high speed chase ensued…he couldn’t get away so he went to his apartment and held up….police surrounded he place…he decided suicide by cop …the captured instead of killed him…now he is doing 25 years…is it safe to say he got 25 years for not paying child support???????

To say someone wrote a book with a confederate flag on it… In what context was the confederate flag used on the cover of that book? To just lay that out there and then say (That is not a good sign when it comes to showing any form of sensitivity for people of color.) I have seen Black authors display such symbology in their writings for reasons of making a point.

Many across the country are finding ways to hold Wal-Mart accountable. Is a bias within it self….when many communities that are in desperate need of retail competition as well as an employer they protest Wal-Mart coming into their neighborhoods. Yet another bias in your blog.

The following has nothing to do with the Heather Ellis case: We are also concerned about the case of Walter Currie, a 15-year old kid in nearby Poplar Bluff, who was sprayed with gasoline and set on fire by one of his white classmates. According to Walter’s mother, the child has been put in separate classes from the other kids, since they were told that his appearance would be disturbing to the students in his class.

    What gives????

Oh, 4real_22 I saw you had a Bachelor’s Degree, can you state in what. All I saw was a Bachelors Degree and it was posted twice. I just thought about it you did say you saw the tape, then there has to be one out there. Do you mind if I turn your name in to the FBI to meet with you and you can tell them where you saw the tape and who showed it to you then they can find out where the real tape is, because they are looking for it. Thanks see how your information was so very helpful. You ever heard the Gospel song God Meant It For My Good!! In the song they lyrics are “The Devil Meant It For Bad, But I’m So Glad God Meant It For My Good”. You meant if for bad, but God put you hear for Heather’s good. Thanks and God Bless You MUCH!!

  • 11-15-2009 9:15 am

This is too 4reall_22 when did you see the tape, because the one that has not been shown to the media and the only people that have seen the tape is attorneys not even all family, and boyce watkins. Why would you get on this forum and tell a lie to try and make someone look bad. There is no audio so there was nothing heard. I did see the tape and what you are saying are LIES!!! It is truley a shame that you would get on here and just tell a LIE and not feel bad about it. Is this the way you get your rocks off by trying to make others look bad, well Baby Girl it didn’t work for you. I CAN HONESTLY SAY NO MATTER WHAT ANYONE ELSE BELIEVES SHE DID NOT DO THE THINGS THAT SHE IS BEING ACCUSED OF. ALSO IF THE TAPE SHOWS IT THEN THERE MUST BE ANOTHER TAPE SOMEWHERE, BECAUSE THE ONE THEY HAVE PRESENTED FOR EVIDENCE DOES NOT. TO TELL THE TRUTH IT DOES NOT INCRIMINATE ANYONE. THERE IS SOMETHING MISSING FROM THE TAPE AND IT IS UNDER INVESTIGATION, AND THIS IS THE TAPE THAT WAS GIVEN BY THE P.A. SO NOW 4REAL_22 IF YOU ARE GOING TO MAKE ACCUSATIONS THEN KNOW WHAT YOU ARE TALKING ABOUT FIRST. ALSO, REMEMBER THE BIBLE SAYS TOUCH NOT MY ANNOINTED AND DO MY PROPHET NO HARM!!! I SUGGEST THAT YOU LEAVE THE PREACHERS DAUGHTER THING ALONE. CAN THE REAL BLACK PEOPLE STAND UP AND STOP BEING SELL OUTS, SHE DID NOT DO WHAT THEY SAID SHE DID, BESIDES YOU HAVE TO KNOW THE AREA AND HOW MANY OTHER BLACK PEOPLE HAVE BEEN ASSAULTED BY THESE SAME POLICE OFFICERS.

GOD BLESS AND PEACE TO ALL!!!

I wish u well Heather, I gotta be in court too

I do believe that since youre one of the chosen few by the media, why dont you ask your colleagues to put more media coverage on this case and put pressure on the DA and the city.I myself will not fight for something that was brought upon their own self.Dont get me wrong I empathize for her, but we must learn to be accountable for our own actions. We can no longer keep protesting and fighting for a nikka moment, sorry for the lack of better words. There’s a bigger issues in our community that needs exposure and deserving of the risk of our lives.

Where were you last month, last week, yesterday,an hour ago,ten minutes ago, 5 minutes ago, 30 seconds ago, when our brothers and sisters are being kidnapped, murdered, became homeless, dropped out of college due to financial strain, raped, molested, robbed, unemployed, laid off, exposed to drugs, drug overdose, etc. etc? WHERE WERE YOU?

i’ve seen video of womens’ moufs get’em in rouble numerous times!

  • 11-14-2009 9:00 am

I saw that tape. While this young lady may not be guilty of a felony, she is certainly guilty of acting like an ass. She tried to fight a police officer. It doesn’t matter who her parents are or what her career aspirations are, she was dead wrong. And frankly, one has to wonder, where was all of her “preacher’s daughter’s” home-training when she was cutting in line and try to fight in a damn store. We all know the system is unfair. Not just based on race, but based on wealth, and most of us manage not to get arrested and charged with felonies. This woman got exactly what she deserves for being an idiot. Its not Walmart’s, mine, yours, or anyone else’s responsibility to help her.

  • 11-14-2009 12:48 am

Well she better do a lot of praying because she’s already in a bias state and despite her education it doesnt mean anything when your put before a bunch of bias azzho jury and you can bet they wont be her peers

Unfortunately, the only way walmart will get involved is if we hit them where it counts more their pocket and thats when we’ll see the support.

its is very apparent that the charges are chumped up especially for a first time offender, its ridiculous that they are even thinking 15 years did she kill the btch azz bias cashier who helped in further escalating this situation

I understand this woman should have thought about all this before she put herself further into this situation and she could have been rolling in dough if she had just kept a cool head let them call the cops

and than sued their fkn bias azzes but unfortunately, she lost her cool, I’m all for supporting someone when it comes to the justice system being miss used and no im not making a excuse for her behavior because as grown adults we

know that there are consquences for the choices we make and if we have future plans for the near future then we sure as hell better behave like it.

Hopefully, they will just reduce her felonies to misd and she can get on with her life and learn from this…

  • 11-14-2009 12:26 am

These are all trumped up charges…a jury will not convict her…and being part of a God fearing family I’m sure they are not only fighting w/ the law but theya re fighting spiritually as well…
