ARLINGTON, Va. — An Army specialist is in jail, accused of making threats against fellow soldiers, including in a vulgar, violent rap song that describes shooting those responsible for his stop-loss orders.

Spc. Marc Hall, an Iraq veteran based at Fort Stewart, Ga., has been in custody since early December. He’s been charged with “conduct prejudicial to the good order and discipline of the armed forces,” allegedly threatening violence on multiple occasions, according to Army charge sheets.

Hall is accused in various specifications of threatening to “go on a rampage,” attack other soldiers if he was deployed, and shoot the brigade and battalion commanders.

Another count accuses him of distributing “original songs wrongfully threatening acts of violence against members of his unit.” Hall reportedly mailed a copy of the song to the Pentagon after receiving his stop-loss orders over the summer. The song, posted on Hall’s personal Web site, does not name anyone specifically.

“The chain of command has a legal obligation to the citizens of the United States to investigate and deal fairly with SPC Hall’s alleged misconduct,” Kevin Larson, a spokesman at Fort Stewart, said in an e-mail. “Anything less would be irresponsible to our citizens and soldiers.”

James Klimaski, a Washington-based lawyer, said that Iraq Veterans Against the War, an anti-war group to which Hall belongs, is trying to raise enough money for Hall to hire him as his civilian attorney. While Hall is jailed, his unit has deployed to Iraq without him, according to Klimaski.

Hall’s song is just a song and should not be taken literally, the lawyer said.

“Listen to rap songs,” Klimaski said. “I mean there are a whole bunch of rap songs talking about killing people all the time. Nobody gets killed from them.”

Klimaski also downplayed the allegations that Hall made additional threats.

“The problem with threats is they can’t be contingent,” he said. “ ‘I will do this if …’ Well that’s not a threat because if ‘if’ doesn’t happen, then there’s no threat. Like, let’s say, ‘I’m going to shoot the battalion commander if I’m deployed.’ Well he’s not been deployed, so he’s not going to shoot the battalion commander, so there’s no threat.”

Klimaski also said the definition of rampage means to run around like a crazy person. “That’s not a threat,” he said.

    They right that they loked his behind up…We just had a shooting here in Texas not to long ago, a Soldier shot 13 inocent people. Why he do it? He didn’t wanna go to Iraq… Come on people, if we dont do something bout them folks then they end up going to Iraq and turning on there fellow Soldier. Then what? Then everybody cries we should of done something when we first found out about the rap song…
    This has nothing to do with color, doesn’t matter if he is black or white. WHAT MATTERS IS HE TALKIN ABOUT SHOOTING HIS FELLOW SOLDIERS, would you want a soldier like that amongst fellow soldiers? Hell Nah!!!…
    He deserves to be in jail.

    I respect this man and I guess he found out what the army was all about. I see nothing wrong with what he did or said and at least he had the heart to express his true feelings. Isn’t there the notion of free speech in this country, why are they bothering him if he didn’t take any action.

    …I thought stop loss has been discontinued by President Obama since August of 2009. If that is the case then this soldier’s unit must have a prejudice against this individual. Yes it’s wrong to make threats but his unit also have a case to answer for using an illegal tool for trying to deploy a soldier who is about being discharged from the Army.

    Its a song man. Lots of rap songs have words not so pleasing to some folks hears and not just rap either. He did not act out on this. Words are words. Some use words and songs to release their tense feeling. As they say sticks and stones can hurt my bones but words can nevr hurt me. Maybe his words were out of the norm but I am sure that there are worse words said and surely worse have been done. Sending a letter to the pentagon was way out there. To me this soldier needs some personal help. I think the soldier should have been disclipine but in a different manner. He should have been counsel on his actions and given some type of extra duty not put in jail.

    SirMoonlite2 so you are retired military and a retired senior NCO so am I. I am surprise that you use such rhetoric toward this young soldier. I was army and as a NCO one must know the NCO traits ” know your soldier and look out for your soldier best interest”, it is clearly plain and simply that this soldier need a mind check. For the record there have been recently officers who just flat out refuse to be deployed and there was no stop loss involved. What do you have to say about that? One officer even said he was not going to be deployed because the commanding chief is not american or born in america. So what do have to say about that? If you are going to feel this way about this young soldier then you should should feel the same about those officers.
