An Ohio mother of two was sentenced to 10 days in jail and placed on three years probation after sending her kids to a school district in which they did not live.  Kelly Williams-Bolar was sentenced by Judge Patricia Cosgrove on Tuesday and will begin serving her sentence immediately.

The jury deliberated for seven hours and the courtroom was packed as the sentence was handed down.  She was convicted on two counts of tampering with court records after registering her two girls as living with their father when they actually lived with her.  The family lived in the housing projects in Akron, Ohio, and the father’s address was in nearby Copley Township.

Additionally, Williams-Bolar’s father, Edward L. Williams, was charged with a fourth-degree felony of grand theft, in which he and his daughter are charged with defrauding the school system for two years of educational services for their girls.  The court determined that sending their children to the wrong school was worth $30,500 in tuition.

When I read about this case, a few thoughts went through my mind.  First, it’s clear that the court is trying to make Kelly Williams-Bolar into an example.  Even the judge in the case, Patricia Cosgrove, said that her sentence was appropriate ”so that others who think they might defraud the school system perhaps will think twice.”

Secondly, it’s interesting how courts find it convenient to make someone into an example when they happen to be poor and black.  I’d love to see how they prosecute wealthy white women who commit the same offense.  Oh, I forgot: Most wealthy white women don’t have to send their kids to the schools located near the projects.

Third, I’m not sure why the court is treating this law-abiding mom like a thug who ran into a building with a shotgun and robbed the district of $30,000.  Instead, they could simply subtract the amount it costs for her kids to go to the second school from the amount that would be spent for them to attend the first one.  I’m sure the difference would still be substantial, since American educational apartheid dictates that schools in poorer neighborhoods are of significantly less quality than other schools.  The racial divisions within American schools are nothing less than a blatant and consistent human rights violation and should certainly be treated as such.

A final interesting blow by Judge Cosgrove that reflects the experience of marginalized African Americans in the criminal justice system relates to Williams-Bolar’s quest to obtain a teaching degree.  The single mother was in school studying to become a teacher so that she could create a better life for her girls.  But that won’t happen for her family now, given that the judge has all but shut the door on her chance to fulfill her dream:

”Because of the felony conviction, you will not be allowed to get your teaching degree under Ohio law as it stands today,” the judge said. ”The court’s taking into consideration that is also a punishment that you will have to serve.”

This case is a textbook example of everything that remains racially wrong with America’s educational, economic and criminal justice systems.  Let’s start from the top: Had Ms. Williams-Bolar been white, she likely would never have been prosecuted for this crime in the first place (I’d love for them to show me a white woman in that area who’s gone to jail for the same crime).  She also is statistically not as likely to be living in a housing project with the need to break an unjust law in order to create a better life for her daughters.   Being black is also correlated with the fact that Williams-Bolar likely didn’t have the resources to hire the kinds of attorneys who could get her out of this mess (since the average black family’s wealth is roughly 1/10 that of white families).  Finally, economic inequality is impactful here because that’s the reason that Williams-Bolar’s school district likely has fewer resources than the school she chose for her kids.  In other words, black people have been historically robbed of our economic opportunities, leading to a two-tiered reality that we are then imprisoned for attempting to alleviate.  That, my friends, is American Racism 101.

This case is a textbook example of how racial-inequality created during slavery and Jim Crow continues to cripple our nation to this day.  There is no logical reason on earth why this mother of two should be dehumanized by going to jail and be left permanently marginalized from future economic and educational opportunities.  Even if you believe in the laws that keep poor kids trapped in underperforming schools, the idea that this woman should be sent to jail for demanding educational access is simply ridiculous.

    It’s a good story. If more of us stood together to find racial inequality things would be done. I’ve noticed a lot of southern blacks don’t care enough to stand up for themselves therefore they will continue to get knocked down further and further from acceptance and equality.

    I see Boyce just trying to drum up more sympathly for Ms. Williams-Bolar. Fact is, she deserves what she gets. The officials in the school district she was illegally sending her kids to confronted her multiple times ordering her not to bring her kids there. She arrogantly refused and thus the judge passed down the harsh sentence.

    What she did, ferrying her kids into another school district , is very common in Ohio and across the country. However, whats different is that when violators are confronted the far majority of them comply with the school officals request to remove their kids.

    Williams-Bolar had a chance to avoid prosecution and refused. I have ZERO sympathy for such arrogance. Noone is above the law; and breaking the law to achieve an end never justify the means.

    I have refrained from this story Yourdaddy123 because of the emotional responses. You, and I believe it was Javon were the only replies that I SAW that were right on. This case is about the law, not what her intent was. We all understand and applaud what she is trying to do, but ultimately, she broke the law. The real issue here is the disparity in quality of schools between the two neighborhoods. I think our focus should be strengthening the existing schools, not breaking the law by lying about residency. Black children deserve access to better schools in their OWN neighborhoods. Keep in mind, while the focus is presently on these two children, what about the thousands of others who can’t break the law to get their children into a better school? The biggest obstacle to improving these schools are these evil teacher unions who remain powerful with support of these Democrats who don’t seem to be at all interested in reforming the system!

If the schools in the poorer neighborhoods were as good as the schools in the richer neighborhoods, then she wouldn’t have to do what she did. This loving mother was not ‘legally’ lynched because she broke the law, she was ‘legally’ lynched because she was Black and had the nerve to attempt to secure better for her children! Recently, a young Black Man, Frederick Jermaine Carter was ‘lynched’ from a tree in North Greenwood, Mississippi. This happened last month on Dec. 3, 2010. The animalistic act was committed by those racist, cowardly whites that are a part of a “all white community”, where Black have never been allowed to live. The ‘legal’ cause of death was suicide? Yep! He hanged his self outside of this community. Just like ‘Emmett Till’ killed his self and dismembered his self in 1955, ten miles from where this ‘legal’ lynching just occurred! In fact, across this nation, all of these cities where there is a ‘racist and nazi’ call to “Take Back There Country”, there has been an alarming increase in ‘legal’ arrest, jailings and violence against Black People! Yesterday, it was reported that those that sponsor ‘Gun Shows’ that travel across America has ‘legally’ lost 62, ooo guns!!! Not a single person has been charged, when it was revealed that the ‘law’ has been violated, because these ‘white’ gun owners are required by law to keep records and report any loss of such guns. 62, 000!!! And, no one said a ‘word’? No one has been arrested or jailed. Some one is having a big, big ‘party’, huh? Family, it ain’t safe? We must begin to look out for and after each other, just like we came to the rescue of this great, loving mother, we must be ‘proactive’ and protect and prevent such transgressions against the ‘Family’ from happening in the first place. This also, applies to those ‘evil ones’ among us, that look like us, walk around us, but is not of us, nor for us, if they victimize ‘any’ of us! There can be no justice for us, if we don’t demand and demonstrate ‘justice’ among us. If we fail to do this, then God will not be for us and all will be lost.

    Its the taxer payers who pay for outta district kids coming to schools in their district, its the the fact she lied, the father was not the custodial parent.Answer is ask for a transfer prior to the new school year, let the father become the custodial parent or get involved with the district she lives in, get with other parents, teachers try and make it happen.
    We can’t go around invading other school districts because their schools are better, we are responsible for our own, no matter , we have to get in the butts of superindents,school boards, no more excuses.
    Every district in this country is under seige , falling tax base, some dealing with large influx of children of illegal immigrants, and larger classes.
    Those are other factors we need to add in this nationwide equation as we go forward in this country.

    Oh yes Yourdaddy123, she is so arrogant because she stood up to a school board that’s basically saying: Leave our rich school and send your kids to a crappy and dangerous inner city school! GOOD LUCK! She may have broke the law, and she may have broke it stubbornly, but you are missing the bigger picture. WHY she did it is what’s important, and the reason is that these district schools segregate children into district schools, and this is based on race due to their socioeconomic stratification in the inner cities. Since white families pay more property tax they get better schools. And thus separate but unequal transcends into the 21st century.

    As usual, Black people are running a bit late. Most states and corresponding municipalities are insolvent right now and on the brink of bankruptcy. There are HUGE efforts underway to save money. High rates of unemployment are cutting into various revenue streams of these towns, cities and states. Bottom line, these people aren’t playing. There are some cities who are handing out speeding tickets if you are one or two miles over the speed limit. There was a town in NJ who recently proposed people who ride bikes to be licensed, there is a town in Connecticut that is seriously thinking about taxing residents and businesses for the amount of storm water that flows from their property into the sewer system. Things that were once overlooked are being enforced heavily now. You will start to see many more incidents like this happen to blacks, whites, hispanics, asians etc. in the not too distant future as these municipalities start to implement extreme measures to either increase revenue or cut costs. Some of you are probably still believing the false hype being propagated by the co-conspirator-in-chief. I have a news flash for you all. When he talks about the economy heading in the right direction, he is not talking about for you. He is talking to and about his buddies on Wall Street and various multinational Corporations like GE.

    Instead of trying to excuse people for breaking the law, why doesn’t Boyce suggest people follow the lead of those at the Bruce Randolph school in Denver Colorado? Failing schools and subsequently failing students are the fault of the residents ultimately. If you have a failing institution in your neighborhood, the first step should be what can we do to repair it, NOT can someone from Government please send more money. Many of the problems of these schools are funds not being spent wisely, not a lack of them!

    While I have no interest in defending the school district, legal system or judge in this matter, I do wish to raise a much broader point for our comprehension and consideration. I believe this is an education-based, “White Horse Moment” for Black Americans.

    I’m sure you’re wondering what in the world is a “White Horse Moment?”

    It is an instance of perfect clarity, when you realize that that life is a beautiful thing, but under many circ**stances, it is neither fair nor equitable. You begin to embrace fully that while you may not have been the cause of your current predicament, you bear the complete responsibility for getting yourself out of that predicament.

    Absolutely outrageous punishment for the crime. Cosgrove was ensuring Ms. Williams-Bolar future would be bleak filled with hardships and limited opportunities. The only protection was to keep the Copley Township school district white. The inflated $30k covering two years for both children is laughable. That tuition calculation is comparable to private school, which even the whitest suburban public school, their resources can’t match…It just shows this country hasn’t come very far and never will until there is justice in the justice system

Indeed many of us have grown up reading “fairy tales” and other “imaginative” stories that have left this impression that a knight in shining armor is always nearby ready to come and save us in a time of trouble or need. Just another out of a LONG list of examples at how this current education system fails us all as HUMAN beings. The people who constructed this current system were/are looking to build a more serviceable pool of working individuals, and were/are not at all interested in producing enlightened individuals. So today as in any other time of our history, there are many educated fools running around. Sounds like an oxy moron right? Sort of like a Smooth Thug! But there is ample evidence that proves the current education system makes you more knowledgeable but not necessarily smarter. They know much but understand very little. This manifests itself in our community more than many others and that’s a fact but one of these days, we will realize that there is only ONE viable solution. We must solve this ourselves or perish! It’s really not that damn complex!

    Ive read every comment on here thus far. I have come to my own conclusion on all this and it’s very simple. This happened cause she was black, period. This same thing is happening righ now in that same school district if you polll it you will find it. There is way more to this story than is being told.. These children went to the school for 2 years folks knew they weren’t from the area cause all the kids know each other. Something happened that cause someone to say, “well they don’t live over here anyway” and this started the ball rolling of how to rid themselves of these two black children. They went the route they they have used against blacks since the ships brought us here, the White mans courts system. This made what the did legal by letter, and showed blacks that Jim Crow is still alive and well in America. White might sile in your face all day but they will never agree to you being on the same level as them… They never will.. Just watch politics today.. White have put a Mason-Dixon line on blacks there as well where the Hell where the Tea-Party folks and all these other white groups that are around now that we have a black President.. They never exisited.. Where was the chat I want my country back, back then there was none. White folks are realizing that blacks want more some of us see the light and know we are better than them and can out do them in all aspects of life as long as we educate ourselves.. Education is the key and this was a blatant move to stop the education of our youth.The message sent was you N***** don’t need a good education we will give you what you need.     I dont think the issue is whether she “broke the law” since it’s clear that she did. The issue, in my opinion, is whether the punishment fit the crime and, more importantly, would the same punishment (in this case JAIL TIME) been handed out if she wasnt Black.

    In the case of the mother;Kelley Williams-Bolar, who was sentenced to 10 days in jail and 3 years of probation,and the probable lost of ever having a teaching livelyhood in the state of Ohio,oe anywhere else possibly, because of of a felony conviction. My question is……where is the “REV. Jackson”;the NAACP;SCLC;Ohio black caucus legislatures. We always seem to get the short end of the stick on everything,but it is even more trying,and difficult to accept when it is when one of us is trying to achieve something for a worthy cause.How soon we forget the blood shed,sweat and tears of so many for an opportunity at equality and fairness.We have forgotten and failed Ms. Williams just like we have forgotten and failed our president Obama.She was abandomed just like President Obama;when the going get tough; then we either jump on the critics bandwagon, or we say to each other so ever quitely that it “ain’t” our fight.We as a people have forgotten how to work hard ,stand firm,and fight for what we want, and be ever so determined about it!If we are going to ever be somebody and say that “WE Are Black and We Are Proud”……then we can tap President Obama on the back and say”Oh By The Way America!!!!     Dear News One I’ve been looking for this story on other news sources to no avail. I need to know why this story is not getting national attention and a responds from black leadership.
    I am also shocked that some comments actually blame Mrs. Kelly-Bolar for being a law-breaker. Im sure if she imagined in her wildest dream she would recieve such a harsh punishment she would have acted differently. But she like the many southern whites ( I happen to know a few) who send thier young boys to other school districts for sports like football, thought the ends justified the means. We all expect the punishment to fit the crime as well.

    This case is revealing since it makes it clear that “school choice” is superseded by “district boundaries” and economics. “No Child Left Behind” doesn’t apply. The “have nots” of society will always be held down, put down and kept in “their place” by the “haves” of society.

    Where I live, you can send your child to an out of district school if you are willing to pay, but that still locks out parents who cannot afford it.

    In all of this, where is the consideration for the children? Clearly it doesn’t exist. Far too many inner-city poor schools are overcrowded, have teachers who either don’t really care to teach or have a hard time teaching because of the behavioral problems of some of the students. Under such conditions, students who have the potential for academic success don’t get what they need and then lose interest in school and hope in a positive future.

    This is happening to one of us because we do nothing about the treatment we recieve. It’s time to take a look in the mirror and ask ourselves why is this acceptable? The public schools in our sector of town are two to three years behind, if not more. My mother was one of those women that when the public school didn’t challenge me she moved into a majority white location and the school were so much ahead. I suffered greatly from having this light skin and being that of African American and I was behind when going there. However, when being called n****r and I couldn’t fight my way out because I was the one wrong in their eyes. I sat listened and soaked up every bit of knowledge I could. I used my anger in a good way and when I became unpredictable they wanted to test me for retardation. My mother being that she was upset by not having a choice with the test took me back to another location of public school with my own people. That to her being her way to keep control over the unfair practice. I was way ahead of my peers at the public school, my teacher loved it but the students hated that I knew so much and spoke proper. I share this because it taught me that I was not accepted by own people when I needed them the most. And ppl destroy what they don’t understand. I saw things different and I would have been willing to share whatever I knew with us for us. However, we cool as it seems with the way things are and that we shouldn’t be… This fight ain’t over but in order to stand up to them we have to stand up against us. We to them are predictable……

    Keep this in mind, when Blacks are given sentences for actions that, as a first time offense should be handled as a FINE & a Warning— POLI-TRICKS come in to play. Statistically, in the past, it was felt that Blacks and other Democrats could be thinned out by creative use of the FELONY Card. Guess how many Democrats you can erase from the books if you can find ways to pass out the FELONY cards on offenses that in many Non-African American and Non-Democratic areas are simply bypassed. Do your homework on this and you’ll find— In some Judgments, the Felony Card is just another way to bring down the Democratic numbers under the colors of the law and justice.

    The good thing here though is it brings to light that you can get better education for your children outside of the realities of where you live. My children’s future and education weighed heavily on where I decided to move. It is good to see Blacks none-the-less see the value of a good education for their children today, and as Obama said we have to out-educate and out-innovate. I’m surprised he has not chimed into this issue, not from a racial perspective, but from the need for us all to care about the quality of education that our children receive.

    wasn’t there a huge debate on education? the government said education is the best way to securing the future of opportunity for our children, and future children. but her we go taking huge leaps backwards. All that woman did was try to ensure her childrens future. ask anybody in this world if they would do the same thing if they were in that woman’s position, that they would do the exact same thing. the thing that really bothers me is that nobody has checked to see how the kids were doing in that school. maybe they were doing very well. but hey what can we do. “education is a privilege not a right”. if I was that jury and judge in that court room, I would not even be able to look at myself in the mirror after that.

    where are the new black leaders? where are the marches? I think that if enough people protest for Ms.Kelly that felony charge can get dropped. President Obama and the first lady needs to know about her story;they can help! We can not let this woman go down, she was trying to get her teachering degree. Once she get her teaching degree, she needs to move to Atlanta or Texas

    This issue isn’t solely about breaking the law, it is about the law being used to keep poor black people ” in their place”. There is no other reason to make something that should warrant a fine at best a felony that effectively locks her out of a professional career and ensures that she’ll never escape poverty in time to help her kids. It is another reminder of just how vulnerable we remain because we will not pull our weight and deal with our social problems with the same focus and emotion that we devote to other things. Scroll down this page and you see stories about Diddy and R. Ross spending a cool mil at a Miami strip club and other pathetic negroes doing ignorant things. Imagine how that mil could’ve helped those kids at that run down Akron school.

    While we wait for the feds and these racist governors to fix our schools, our kids go without. One less mansion, gun charge, dogfighting ring, more concern for those people left behind will change the equation. Dr. King and the others didn’t have these luxuries and they paid with their lives so we could. Let’s return their favor.
