As I stood in the courtyard of Jackson State Prison in Georgia yesterday holding a prayer vigil for Troy Anthony Davis, I, like so many others held out hope for some sort of miracle. In the exact location where I joined Troy’s mother in 2008 when we received such a miracle 90 minutes before his scheduled execution, perhaps I was too optimistic in believing that similar action could take place and justice would prevail.

Check out the rest of our Troy Davis coverage here

Top 5 Most Wrongful Executions Ever

Despite the fact that there was a last minute delay in Troy’s execution last night that sent jubilation throughout the crowd, all of us collectively watched as he was eventually put to death. This time, even with an expansive global movement to save his life, the miracle unfortunately never arrived.

Ever since I was first introduced to the Troy Davis case several years ago, I have been perplexed as to how a man was convicted based solely on eyewitness statements and without any physical evidence. No weapon, no DNA and no proof other than the fact that some people stated he committed the alleged crime. But what makes Troy’s case an utter travesty in our legal system is the fact that 7 out of these 9 witnesses have since recanted their testimony and many said that they were coerced or pressured into pointing the finger at Troy. And yet, he was still executed last night.

One of the two remaining witnesses who did not recant his/her testimony was a man by the name of Sylvester ‘Redd’ Coles — another suspect in this case. And yet, Troy was still executed last night. A female witness even stated that she was threatened by Coles if she came forward, and yet Troy was still executed last night. Everyone from former President Jimmy Carter and Archbishop Desmond Tutu to former prison wardens and conservatives who are pro-death penalty pushed for a stay in this man’s death penalty, and yet Troy was still executed last night.

I will be traveling to Washington, D.C. to meet with the Justice Department to push for a federal law that prohibits any state from prosecuting a capital case based solely on eyewitness testimony. Nowhere in America should an individual be executed again without any concrete physical evidence. And at this time, as we mourn the loss of Troy, we must continue to move as well — to mourn without moving only compounds this most egregious injustice.

Although it may be very difficult, especially for those that knew Troy and those that fought on his behalf for years, we all must push forward and ensure that his death was not in vain. A federal law is absolutely necessary, and whether one is pro-death penalty or anti-death penalty like myself, we need to set the bar to where concrete evidence must be required before taking a person’s life.

For those of us who were pushing for a stay in Troy’s execution, do not let anyone paint you as against the family of the slain police officer in this case, Mark MacPhail — for that is the furthest thing from the truth. Our deepest sympathies go out to the MacPhail family, and because they too deserve justice, a re-examination of this case was essential in order to truly determine who was culpable. That’s all Troy Davis asked for; a chance to halt his execution and receive a fair day in court. But tragically, that opportunity was diminished last night.

As I left Georgia yesterday to return to NY, I was consumed in the irony that so many heads of state were gathered at the UN and heard the U.S. stress the importance of human rights while we simultaneously executed this man. What did they think as they turned on the news, read the papers and watched how we behaved? In order to preach and advocate for rule of law and civil/human rights, we must first rectify our own miscarriages of justice at home.

Troy Davis died at the age of 42, after spending 22 years behind bars. As we know all too well, those with money and the ability to hire high-powered attorneys receive the best defense and fighting chance in court. Imagine if one day you woke up and someone accused you of murder and you were then sentenced to death for it. That’s pretty much what happened to Troy.

Based solely on eyewitness testimony that is almost unanimously recanted, a man’s life was cut short last night. If laws are designed to protect us and establish a humane society, we must rectify them so that this sort of injustice never happens again.

Mourn we must, but we must continue to move. Carry on the fighting spirit of Troy Davis who till his last breath, proclaimed his innocence.

WHAT I can’t OVERstand is , WHERE were all these Black high profile attorneys BEFORE Troy was murdered? HOW COME they DID NOT represent Troy WHEN this happened? We have all these attorneys on radio stations, how come they are Monday quarterbacks, but waited 20 damn years BEFORE they TRIED to represent him? HOW COME Alley didn’t bring this to the surface 20 years ago? WHY are they talking all this bulls**t after Troy is now dead?

I ain’t hating, I’m just bringing up questions!

WHO, WHAT, WHERE, WHY AND HOW COME?

I wish people (especially black people) would stop saying this was a miscarriage of justice. The justice system as established by those in power in this God-forsaken country worked perfectly when they murdered Troy Davis. The only miscarriage that accorded that day was they had to kill one of their own for killing a “n****r.”

I agree with you, Iwillbfree. Where were they. Now, that this young man’s life was cut short, unjustifiably, everyone is talking about what should have been. Any BLACK leader that allowed this travesty of injustice to happen, are all to blame. Anyone that says that this was the correct thing to do is utterly stupid and dumb. You do not know the facts. That I can tell by your comment. Troy Davis was not a murderer. The state of Georgia is the murderer. But, the really sad thing about all of this is they cannot bring him back, with their apologies. RIP Mr. Davis.

Vanity 357—This could happen to you too.

  • http://twitter.com/Vanity357 Vanity357

Re-read the comment. It is not an injustice because the system was established to keep black people in their place. Therefore, Troy Davis is a victim of the justice system as it was created by white people which means by THOSE standards it is not an injustice. Until we stand up to what is going on, it will continue to be the standard.

Good Lord, I try, but I’m really beginning to wonder if reading comprehension is lost on this generation.

Maybe this will help you understand, it’s about money!, a black ,white ,spanish lawyer is in it for the all mighty $$, 99% of the time. they get involved when they see free air-time or $ signs. troy davis was a nobody in the world of get me on camera, get me my check$, and in the world of al sharpton, cornel west, maxine waters, jerimiah white, and tamika mallory he meant nothing. You people are not getting it, it’s not about black/white anymore, it’s about class war-fare!

I tought the same thing, never heard of Troy Davis on Black radio or TV till last week. The white power structure is sending a message, they are getting the masses prepared for executions by the state,Nazi style.Malcolm X warned us in the last message how this nation is no different than Nazi Germany when it comes down to us.This execution was meant to work on the psychic of the mind, traumatize and shock, paralyze the mind. But the masses will forget,it will be business as usual,as Malcolm X said, the devil is on a rampage.

This was depressing on more than one side. The code of silence that keeps one from pointing out the real killer. If Davis had revealed the real killer, who was with him at the time of the murder, he, Troy Davis, and/or his family members would have been killed. I truly believe the courts knew this as well as knowing that he was not the killer. Were they using Troy to send a message? Whatever they were doing, I strongly feel they had a responsibility of proving without a shadow of a doubt that he was the killer which they could not do. Troy did not lie when he left; he stuck with the truth protecting his family.

  • Anonymous

They all know about that code of silence. The cops have a blue code of silence. Snitching can cost your life; it does. Parents be careful who your children hang out with.

  • Anonymous

Sharpton and Judge Mathis know about the “code of silence”. Again, parents check out who your kids are hanging out with.

Yeah, right on. I never even heard about this case before, So all of a sudden, Boooommmm, We are supposed to support this just because of the talking heads who need exposure in the media. They love these guys in prison so much, then they alone should support them and put money on their books and pay for their lawyers. Don’t wait until a day or two before they are ready to walk that last mile, The full blast, the Sharpton’s and West and Smiley are all over themselves, in the media, like they some champion of the people, What ? the people who commit crimes against other people. Where are they now, ( sic ) Won’t hear from them until another big story hits the media, Just like those guys who listens to police traffic reports, ( accident chasers ), with their tow trucks ready to roll, and hack lawyers trying to make a fast buck, these guys got their, ears on and antenna up, storm chasers that’s about all, this guys are good for. Just this past weekend alone, in the Country , how many black men have killed other black people, I don’t hear nobody up in rage over that! When do the people get to shout , the threat is dead, we can walk the streets in safety, for a minute.

I have been told (in Church) that nuthin happens unless God permits it to happen. In view of all the moral support he was given, and all “THE PRAYERS” that went forth on his behalf, the execution of Troy Anthony Davis must have been a part of God’s permissive will. In order to make an omlet, you must crack some eggs beloved. To be more specific: “Perhaps God allowed him to be sacrificed in order to begin a serious dialogue about the injustice of Capital Punishmen?” In view of all the people who have been vindicated by DNA (some on death row), it’s obvious the Judicial System is not only racist but “FLAWED!” I heard the Officer’s Mother say (during an interview) that Troy Davis was accused of shooting another male earlier that day, and the same gun that fired those bullets fired the bullets that killed the Police Officer, but if that was the case, I wonder why they ever posponded his excution? I heard that Troy Davis was in rightstanding with God when he left this earth, therefore his trials and tribulations are over! “GLORY HALLELUJAH” So sincere, Michael Sydney Perkins

I been hearing alot of stupid people throwing their lot in with this sc**bag troy davis.first of all they HAD D.N.A. evidence against troy. the police went to troys mothers house a day after the shooting, and took a pair of shorts out of his mothers dryer, tested the shorts ,and low and behold ,the cops blood. but the judge threw this evidence out because the police did not have a search warrant for the mothers house. NOBODY ,and I mean NOBODY wants to bring this up to prove troys INNOCENCE. these people that recanted waited 16 YEARS to recant,16 YEARS.Steven Sanders NEVER recanted …His words ” you never forget someone that stands over someone and shoots ,with a smile on their face” another witness also said that troy stood over the officer and shot ” with a smile on his face” troy shot Micheal Cooper a few hours before he MURDERED the cop. Collins was with him, and testified to this fact. the bullet that they took out of Coopers mouth matched the bullet taken from the police officers chest.ballistics PROVED that these two bullets were shot from the SAME gun. OH ,DID I MENTION THE SHORTS?

Yes, and, now, that he is GONE, what are we going to do about it? Everything humanly possible should have been done to save this man. Am I saying that he was innocent? No. I am saying that he was not proven guilty. I will forever remember Mr. Davis looking up from the guerney at the MacPhail family, telling them to look further, that he was innocent. He was a strong wronged man. I pray for his family, who loved him dearly. To lose someone, with such uncertainty, surely cannot be an easy thing to endure. Yes, and where were the people who could have helped him? They waited up until the end to do something, that should have been done long before the end. RIP Mr. Davis.

In my personal involvement in procreations and nomenclatures in this current committe on reproduction of life, I find that the purposed issue with the name Troy Anthony (nat) Davis is a poison that should be federally investigated. Purposed cloning for the purpose of a disease plaguing our recent country of immigration of the alien’s green card. This systematic death around the calculatable southern states genre of steady racism, does indicate that this person was born to die. Due to the fact our intelligence agencies cannot or will not explore the ideation of a genetic war, frugalized to initiate a personal loss, or determine that what goes on behind the green doors of todays labs, can consitute making over another being and setting them up full and complete with afterlife effects. In other words a scientist or industrial business purveyor of available statistics can lead to a point for point reference from an analytical point of view. If that nomenclature shatters theories of incidence, but more closely indicates a storyline, like John or Jane Doe’s reason for living leads us to accept no connective tissues involved when naming your child John Doe or Jane Doe., however when the combined historical reference taps a well a little too often with always Glen’s fault for the racism, as a name Glenn has come to be reconized as a racist indicator for name reference. In other words, why would our country accept the flagrant uses indicated in the I’m A Clone Foundation, without conceeding there could also be a clear relegation of “Made for Hire”, Made for War of the Clones, Union Made indentions that tear apart the avid scientific mind. All that glitters is not gold. What if all policemen were “made to hire” and all white in a city that had people of mixed colors.? It is my contention we are in the middle of an internal security problem, that overplays KLAN, CLONNs and not enough attention for this bease called BIOTERROISM aimed and selected to perpetrate fraud and crime. When this bioterroism is not suspected but to that one individual loosing someone in their life by that same name to especially an issue of life taken by justice department, we are in a dangerous plot in the melting pot. Occidental cloning, for industrial purposes only.

    Dear Mr. Sharpton;
I am writing about the unfair and injustice my son, Andrew Essien, III received at his sentencing hearing. Andrew is a 20-year old African American, college student with a GPA of 3.6, business owner, brother of two sisters, and beloved son.
An incident occurred on May 8, 2010 in which one young man committed armed robbery; my son was at the scene but not an active participant. There were also two other co-defendants involved. My son called for his cousin to give him a ride away from these other individuals, but all were arrested. The gunman, plead guilty for his actions (but never made a statement to police and never implicated anyone else). He was sentenced to 5 years supervision with 2.5 years of imprisonment. My son however cooperated with police, told them what he saw, knew, and furthermore the victims stated that my son did not have an active part in the crimes against them. However, he was still convicted for a crime that he did not commit. On this past Monday, October 25, 2011 Andrew was sentenced the same as the gunman.
Andrew did not have a prior record nor has he ever been in trouble with the law. Yet another co-defendant received a lesser sentence of 3.5 years supervision and 1 year imprisonment. This young man also did not make a statement to police.
If the two co-defendants were not identified by victims, why did the judge sentence each one differently?

According to The Wisconsin Racial Disparities Project, (2011) Milwaukee has one of the highest racial disparities rates among African Americans, who are imprisoned at least eight times as often as European Americans. This growth was not due to growing crime rates, but to greater use of incarceration for lesser offenses and drug offenses.
I believe that high incarceration rates ruin people’s lives and make the problem worse, by making it harder for young people who have done wrong to be rehabilitated, find jobs, and become productive members of society.
I ask you, where’s the justice? I ask that you consider joining me and others in promoting awareness about unjust treatment in this city and across the Nation. Share my son’s story.
    Sincerely,
    A very concerned mother

Too bad about your son. Newsflash – American Africans, should be imprisoned at a rate of at least eight times as often as European Americans because they perpetrate at least eight times the number of crimes as whitey. Get control of your animals.

I agree fam. We (The world) were witness to a lynching of an innocent black man! We stood by and let it happen. It was news for years and we ignored it! A dope dealer that destroys our communities get shot and we wanna hold candles and sing spirituals. This brother gets murdered “legaly” and we just watch. If he was a basketball player or a rapper, everybody would be up in arms! But since it`s a “regular” brother our people don`t care. Look around, our people cried and mourned for tupac and biggie, but Troy Davis, Kathryn Johnston, we pretend to care because it`s popular! I don`t understand. The president could have voiced his concern too, but I won`t touch that. Folks, the state of black america is starting to concern me. But judging from our rates of incarceration, abortion, drug abuse, and violence against each other, we`re goin extinct anyway. Our best and brightest choose not to reproduce, and the dumbest and “Dimmest” pop out little ones that would rather smoke weed and rob each other than educate and uplift our race!
Rappers, singers, athletes, etc are just playing into the hands of those that hate us! Just like after slavery, we are entertainment for white folk. Stop supporting this garbage people! It`s time to become doctors and lawyers, educators and policy makers! Sorry fam, I got carried away.
