Uganda Gay Death Penalty

KAMPALA, Uganda — Proposed legislation would impose the death penalty for some gay Ugandans, and their family and friends could face up to seven years in jail if they fail to report them to authorities. Even landlords could be imprisoned for renting to homosexuals.

Gay rights activists say the bill, which has prompted growing international opposition, promotes hatred and could set back efforts to combat HIV/AIDS. They believe the bill is part of a continentwide backlash because Africa’s gay community is becoming more vocal.

“It’s a question of visibility,” said David Cato, who became an activist after he was beaten up four times, arrested twice, fired from his teaching job and outed in the press because he is gay. “When we come out and ask for our rights, they pass laws against us.”

The legislation has drawn global attention from activists across the spectrum of views on gay issues. The measure was proposed in Uganda following a visit by leaders of U.S. conservative Christian ministries that promote therapy for gays to become heterosexual. However, at least one of those leaders has denounced the bill, as have some other conservative and liberal Christians in the United States.

Gay rights activists say the legislation is likely to pass. But the bill is still being debated and could undergo changes before a vote, which has not yet been set.

The Ugandan legislation in its current form would mandate a death sentence for active homosexuals living with HIV or in cases of same-sex rape. “Serial offenders” also could face capital punishment, but the legislation does not define the term. Anyone convicted of a homosexual act faces life imprisonment.

Anyone who “aids, abets, counsels or procures another to engage of acts of homosexuality” faces seven years in prison if convicted. Landlords who rent rooms or homes to homosexuals also could get seven years and anyone with “religious, political, economic or social authority” who fails to report anyone violating the act faces three years.

Gay rights activists abroad are focusing on the legislation. A protest against the bill is planned for Thursday in London; protests were held last month in New York and Washington.

David Bahati, the legislator sponsoring the bill, said he was encouraging “constructive criticism” to improve the law, but insisted strict measures were necessary to stop homosexuals from “recruiting” schoolchildren.

“The youths in secondary schools copy everything from the Western world and America,” said high school teacher David Kisambira. “A good number of students have been converted into gays. We hear there are groups of people given money by some gay organizations in developed countries to recruit youth into gay activities.”

Uganda’s ethics minister, James Nsaba Buturo, said the death sentence clause would probably be reviewed but maintained the law was necessary to counter foreign influence. He said homosexuality “is not natural in Uganda,” a view echoed by some Ugandans.

“I feel that the bill is good and necessary, but I don’t think gays should be killed. They should be imprisoned for about a year and warned never to do it again. The family is in danger in Uganda because the rate at which vice is spreading is appalling,” said shopkeeper John Muwanguzi.

Uganda is not the only country considering anti-gay laws. Nigeria, where homosexuality is already punishable by imprisonment or death, is considering strengthening penalties for activities deemed to promote it. Burundi just banned same-sex relationships and Rwanda is considering it.

Homophobia is rife even in more tolerant African countries.

In Kenya, homosexuality is illegal but the government has acknowledged its existence by launching a sexual orientation survey to improve health care. Nevertheless, the recent marriage of two Kenyan men in London caused outrage. The men’s families in Kenya were harassed by reporters and villagers.

In South Africa, the only African nation to recognize gay marriage, gangs carry out so-called “corrective” rapes on lesbians. A 19-year-old lesbian athlete was gang-raped, tortured and murdered in 2008.

Debate over the Ugandan bill follows a conference in the capital Kampala earlier this year attended by American activists who consider same-gender relationships sinful, and believe gays and lesbians can become heterosexual through prayer and counseling. Author Don Schmierer and “sexual reorientation coach” Caleb Lee Brundidge took part; they did not respond to interview requests.

A third American who took part in the conference in Uganda, Scott Lively, said the bill has gone too far.

“I agree with the general goal but this law is far too harsh,” said Lively, a California-based preacher and author of “The Pink Swastika” and other books that advise parents how to “recruit-proof” their children from gays.

“Society should actively discourage all sex outside of marriage and that includes homosexuality … The family is under threat,” he said. Gay people “should not be parading around the streets,” he added.

Frank Mugisha, a gay Ugandan human rights activist, said the bill was so poorly worded that someone could be imprisoned for giving a hug.

“This bill is promoting hatred,” he said. “We’re turning Uganda into a police state. It will drive people to suicide.”

Buturo played down the influence of foreign evangelicals, saying the proposed legislation was an expression of popular outrage against “repugnant” practices. But activists like Cato argue anti-gay attitudes are a foreign import.

“In the beginning, when the missionaries brought religion, they said they were bringing love,” he said. “Instead they brought hate, through homophobia.”

Susan Timberlake, a senior adviser on human rights and law from UNAIDS, said such laws could hinder the fight against HIV/AIDS by driving people further underground. And activists also worry that the legislation could be used to blackmail or silence government critics.

Cato said he thinks the Ugandan bill will pass, perhaps in an altered form.

“It’s such a setback. But I hope we can overcome it,” he said. “I cannot believe this is happening in the 21st century.”

Oh but Im sure you dont think you deserve to die for telling someone a white lie huh? The bible says no sin outweights the other! Whether you lie, steal, cheat, kill, or whatever, it is still the same in Gods eyes, and only HE can judge.

    Before you stop and type someone so ignorant, stop and put yourself in that persons shoes for a min. What if it were illegal to be straight? You cant help being you now can you? Doesn’t matter, because in that kind of society, you would be dead no matter how you feel!

    It is sad but very true that Africa kills its children. Many years ago Africa sold its children into slavery. Till today Africa had not recovered from this loss. Recently civil wars ravaged through the continent like bush fire. Uganda had just about got itself out of that primitive brutality that lasted for almost twenty years. People were killed, men, women, children raped and destroyed, mayhem!.

    Rulers are not in position till today to “kill” the hunger and starvation, lamentation still roving the whole of Africa. Young, strong, healthy educated men and women are leaving the land in scores to slave for food in other countries. We call this new slavery “brain drain”.
    But inside all these one African state designs a law to kill homosexuals. After political friends and opponents, civil rights fighters had been discouraged or chased out of the land if not killed. And now this law, supposing it will change anything. One will say homosexuality is not natural in Uganda, and I ask “is hunger and deprivation human or natural in Uganda? “

    Somewhere the bible tells us God rained fire to destroy them. What went wrong the bible never tells us but today homos are scattered all over the world, in all religions. Even the city of Sodom and Gomorrah had reincarnated in Ghana.- (Laughter)
    Now as if to correct the divine failure Africa considers the continued killing of her children!
    Societies that actively discourage all sex outside of marriage must have means of recreation, a word that do not exist in African lives.
    The life itself is so hard; it is not easy to eat. Men are afraid of the women, who face the brunt aftermath of sex, and therefore hope for their “advances” before giving in to dates. Etc.

    All I ask for is: Africa must find a real way out of its problems and STOP killing its children.
    Soon it will be X’mas, and that day the sorrows will soon be baack after the illusions of of God’s love had been shared with a great haleluya!.

    Whoa, Uganda aint playin! I had to read this story about 4 times I was so stunned by the extremity of it. BUT I’m not mad at Uganda for the FOUNDATION of the bill/law they are trying to impose because the ‘gay’ thing has really gotten out of control. I honestly do not think that there would be so many young, gay, black people in the world if it wasnt so widely accepted and GLAMOURIZED in the media. Everyone makes it so ‘cool’ to be gay and thats just not the case. It can be, left to young, ignorant people, very risky and unsafe. I could see if the gay community made it a BIGGER goal to educate people on appropriate sexual behaviors, but they dont in my opinion, again I say MY OPINION.

    When I worked for the CDC in GA years ago, there were always studies being run within the LGBT communities and it was found that 65% of LGBT males/females between the ages of 13-35 did not think one could contract an STD through anal sex OR if they didnt ‘swallow’ during oral sex…HHMMMMM, Maybe this is why Uganda is taking such extreme measures, because too many people are IGNORANT to whats really goin’ on. And gay people can sit back and act like they arent one of the highest factors for STD’s these days and they can sit back and be BLIND to the FACT that they are. What kills me about gay people is the oft overused way they throw the Bible around…The Bible has got to be one of THEE MOST backward, fraudulent, hypocritical books I have ever come across. Now I’m no ‘homo-phobe’, hey do you if thats what you want to do…but people like tyra banks and wendy williams, being is that they are front runners supporters of the lifestyle, should do a better job of informing as opposed to glorifying…
    I feel deeply for the young people of Uganda because had it not been for those they SEE and try to be like, they wouldnt be in the very heinous predicament they are in…People, we need to lead by better example for these children…everywhere.

    I find it REALLY hypocritical of the africa nation can at random without conscience LET the RAPE of little girls and in some cases KILLED them daily and NOTHING is done about it. Not a WORD from africa authorities noted worldwide, I would THINK as a nation THEY would have more concerns as a nation for their PPL and the horrific life of africans in general.

    If you think STD/HIV/AIDS ..which has KILLED generations of african children is because of gay PPL you are uninformed, uneducated and a homophobic.. just like the african lawmakers who believe such ignorance.

    I could care less what gay PPL do and they have nothing as a threat to do with my life as a heterosexual..it’s their life. And believe me if any nation who implement the death penalty becuz of one’s FREEDOM to be who they are..IS insane and the nation as a WHOLE will answer for committing such a horrendus CRIME against someone who is not doing anything to hurt anyone. If you don’t like GAYs..ok.. its you choice in a nation of freedoms named AMERICA..but to AGREE to put gays to death in Uganda is horrendus and so..until a nation learns to live in harmony and deal with their issues- sensible.. you will have starvation, PPL living in mud huts, disease(etc.,)..and a host of other things that will BRING NOTHING but hardship to its nation’s PPL..hence the reason africa is having such a TERRIBLE time for LACK of education and IGNORANCE.     At the risk of being labeled “homo-phobic,” I fully understand the resistance of many African nations to accepting homosexuality. This “sexual behavior” was introduced to Africa via European colonization, and creates chaos, family, and societal BREAKDOWN.

    Most Americans (especially black Americans) do NOT understand the concept of GROUP (we) having more priority over SELF-INTEREST (all about me). This poisonous individual explains the sad condition of the black community today where people’s “pursuit of personal happiness” overrides commitment to community, family, even children.

    Am I saying homosexuals should be executed? hell no.

    What I’m saying — bottom line — is no nation can prosper OR survive if men are bonding with other men instead of bonding with women and building stable families. There’s a fundamental, biological reason homosexuals can’t reproduce, and it’s not my judgment, that’s Mother Nature (God) speaking…

    Uganda, Uganda, my heart weeps for you because even though the rain falls frequently upon your land in the south and beautiful lakes run through your northern region, they have not cleansed you from your transgressions for you are still blinded by hatred, fear, and intolerance, and cannot see that the sun rises upon the just and the unjust, so that all men may be wooed to the Creator by love and mercy and not by hatred and discrimination!

    For hundreds of years other nations robbed you of your wealth, stole your children and carried them away to foreign lands and enslaved them. Even today, in many regions of your country you suffer from extreme poverty because of usury and exploitation from men who lusted after your riches, saw you could not defend yourself, and carried them away to distant lands.

    You must be very careful lest the handwriting of God also appear in judgment for your offenses and likewise be written upon your walls and inscribed in your Constitution now laced with fear and intolerance, having been saturated by the influence of misguided, self-seeking American Evangelists, these words spoken by the prophet Daniel: “MENE, MENE, TEKEL, UPHARSIN” The interpretation:

    “God has numbered your kingdom, and finished it; TEKEK: You have been weighed in the balances, and found wanting; PERES: Your kingdom has been divided, and given to another!”

    Thousands of you marched in your city streets to rid yourself of a sin that you say will most certainly bring the judgment of Sodom and Gomorrah upon your land; but like the Scribes and the Pharisees of Jesus’ day, legalism and an incorrect interpretation of the Holy Scriptures have blinded you.

    Because of your hatred for what you do not understand, The Prince of Darkness deceives you yet again; prostituting you like the demented king you managed to free yourself from decades ago; have you still not heard the words of Jesus who said, “He was a murderer from the beginning?”

    Uganda, Uganda, my heart weeps for you! Don’t you know that you cannot kill the innocent, batter and abuse your children, and lock them away in dungeons of cruelty for life simply because you refuse to accept who they really are without the very King of the Universe (whom you claim you worship), championing their cause, and lifting his righteous hand of justice and judgment against you?

    He has heard the voice of the children devastated by earthquakes and disaster in Haiti and He has freed the oppressed in America from hundreds of years of discrimination. He has even delivered the Jews from the oppression of a mighty pharaoh (once thought invincible) in Egypt. Surely, He will not turn a deaf ear to innocent same-gender-loving people in your country, nor allow you to murder them without cause and your land and your people not be judged for doing so!

    @PimpinDonnP: There are several animal species that engage in Homosexuality, however that’s neither here nor there. We are talking about Human Beings that have intellect (well some of us, these posts are scary) and should be able to have reason. Personally I don’t care about ignorant people who pick and choose Scripture to suit there lives, I know who i am and I am okay with it. (So is my Partner)What Uganda is proposing is Murder plain and simple. It will not stop the epidemic AIDS (NO ONE WANTS TO ADDRESS THE RAPING AND TORTURE OF CHILDREN BY HETROSEXUAL MALES SPREADING AIDS/HIV) It will not put an end to Homosexuality. Nonsense and it breaks my heart that otherwise intelligent people will condone such savage behavior. . . . .Heaven Weeps!

    D Mother land, D Mother of all who lives, if you start this you must be willing to go all the way. And not just in one place but all of the land.And since you don’t control all that is called Africa you can not kill off this thing that is called Homosexuality. I think people who are fighting to save their children mean well but I think they must change the way their children view the Western World.

    Actually, it’s not just gay people. There are prostitutes in Africa that are infected with HIV/AIDS, but men still sleep with them. By the way, some of those men are truckers that leave and go elsewhere to spread it. This has been going on for quite a while and you see the results. Everyone gets quarantined and tested. That’s all it takes…

    Truth is, homosexuality never pops up in a culture, until that culture develops an economic system which allows for people to have long periods of leisure time, or a lot of time to sit around and think about sex.

    In societies and cultures where the population has to give most of it’s time to work and fufill survival needs, sexual norms are without question or further thought. The whole objective is not self objectification, but the fufillment of family and community needs, and the roles therin.

    Only in cultures where there are large numbers of people with nothing better to do, do you get prostitution, homosexuality, promiscuity and the subsequent problems each of them brings.

    Thus, if the men and women in these countries would set themselves to organizing and building their communities, a lot of these problems would go away, very simply…….
