Shaniya Davis’ Mother May Be Charged With Murder

The father of a 5-year-old girl whose body was found off a rural North Carolina road regrets giving the girl’s mother a chance to raise their daughter, even though she seemed to be getting her life together.
Shaniya Davis’ father, Bradley Lockhart, said he had a one-night stand with Antoinette Davis and mostly brought up their daughter before letting Davis take care of her.
A month later, Shaniya was dead, her body dumped off a rural road and her mother accused of selling her for sex.
So, even if Antoinette Davis is not directly linked to her killing, could she be charged in some way in her daughter’s death?
Former Massachusetts prosecutor Wendy Murphy said on “The Early Show” she can’t predict.
However, Murphy said, if Davis knew the child was being taken or delivered for prostitution purposes, then she could be charged with murder under the felony murder rule.
Murphy explained, “She’s responsible for the consequences of a murder that follows in connection with a felony, and it certainly is a felony that she’s charged with thus far. So the possibility is there, for sure.”
As for prosecuting Shaniya’s 25-year-old mother, Murphy said, it could be hard persuading a judge and jury that a mother is capable of selling her child into prostitution.
“Believe it or not, that’s going to be the best defense here, just saying to the jury, ‘It doesn’t make sense, therefore, you have reasonable doubt,’ ” Murphy said. “And believe me, it works. But the truth is, sometimes mothers are capable of terrible things, and we romanticize motherhood sometimes to our own disadvantage, especially when it comes to protecting children. We have to be willing to accept that, sometimes, mothers can do things like this, literally selling their children for money.”
Murphy said Antoinette Davis could have been desperate, perhaps with a history of addiction.
“She might have a drug debt of some sort,” Murphy said. “I’m speculating here of course, but desperate mothers sometimes do terrible things.”

SANFORD, NC (WTVD) — Fayetteville police said Monday they have found the body of missing 5-year-old Shaniya Davis.
The child’s remains were located in an area bordered by Highway 87 south and Walker Road – just south of Sanford – during a second day of searching.
Davis was last seen alive at a Comfort Suites hotel in Sanford last week – the same morning her mother reported her missing from her Fayetteville home. Police say a surveillance video from the hotel showed the child with 29-year-old Mario McNeill.
The area where police found the body is about 7 miles from the hotel.
Mom Accused Of Selling 5-Year-Old Daughter Into Prostitution, [Updated 11.16.09, 9:58 p.m.]
FAYETTEVILLE, N.C. – A North Carolina mother accused of offering her 5-year-old daughter for prostitution is expected to appear in court.
Authorities were searching again Monday for Shaniya (shuh-NY-uh) Davis, who was reported missing by her mother last Tuesday.
Police arrested 25-year-old Antoinette Davis Saturday and charged her with human trafficking, felony child abuse involving prostitution and filing a false police report.
A short time after she reported Shaniya missing, a surveillance camera recorded a man carrying her into a hotel room in Sanford, about 30 miles away.
Police say that man, Mario Andrette McNeill, is charged in the girl’s kidnapping and he has said he doesn’t know where the girl is.

Currently, we are living in our darkest hour. Our children and elders are the ones catching the most hell and they are the ones who should be the first to be protected. Shaniya is ONE story that we’ve been exposed to. Imagine the others that are suffering right now as we speak. I may not be 1st on my 15 year old son’s favorite people list at times because he doesn’t have the “freedom” that his friends have, or because I ask all the questions that he wishes I’d forget,or because his business is my business. Not to mention, how my family lovingly makes fun of me because my 3yr. old daughter has only spent the night away from me 3x’s in her life(with my Aunt who I loved being with as a child,teenager and adult).Protective? Damn right, its my job to be! We get one shot to love,nurture,and PROTECT our children and in turn, if we did our job right, they’ll do the same for us when we become older. It’s the circle of life. I don’t even want to go into methods of punishment for all parties involved in Shaniya’s demise. God will take care of that. I am from Fayetteville, not far from where they had the funeral for Shaniya. It has been sad here every since they found this little girl in Sanford. I have read a lot comments all bashing the father of Shaniya, when all this man was doing was letting her be a mother to her. We can’t see into someone’s mind and know what they are thinking and it is sad that this angel is gone. The mother was only suppose to have her for the weekend. The grandmother packed enough clothes for her for 2 days because she had school that Monday. That grandmother(the father’s mother)called and the mother told her she will never see Shaniya again and then Tuesday comes and she’s missing. This mother is sick and should feel the same fate as that jackass who did it. To the family of mother who says “my daughter will never harm her kids”, you aren’t around your daughter 24/7 to know what she is doing all the time. this little girl had burns on her from her mother’s friends, Only one person on her mother’s side had sense when she said, “If she was doing this all the time, she hid it real well.” This is sad, so very sad…Rest in peace Shaniya because now you are home honey and no more harm can come to you.

I am from Fayetteville and you won’t believe this. When she was at the courthouse she had no remorse at all and she is pregnant. She has a son that DSS took form her. She is a messed up woman and i hope and pray justice will be served to a people involved
Now I am mother of one, I have a beautiful little girl she will be two next year march and there is no way in the world that I would do anything to harm my child. I am a single mother I work fulltime and I go to school full time in completion of my bachelors in Early Child hood Education. If anyone hurts my child will have to answer to me. We say that there are some deadbeat dads out there well there are some deadbeat moms out there. And she is an perfect example of a deadbeat mother, you are going to sell ur child for sex knowing that what hell that child will face. They should kill her and that no good son of a b**** that killed the little girl. These kids are the next tomorrow. That little could have grown up and be anything in life but her life was cut short because of her mother. What type of woman would sell her child for sex? It’s a shame, shame, shame. There are no words to describe how I personally feel towards many of these young mother’s today. It makes me cringe, thinking of this child being sold into prostitution.
