DETROIT – The night Demarco Harris shot and killed a woman during a robbery on a Detroit street, his parents told police knocking on their door at 2 a.m. they didn’t know where their 12-year-old was.

Wayne County Prosecutor Kym Worthy said that’s indicative of a larger issue in Detroit, where the lack of making parents accountable for their children partly is blamed on elevated truancy and dropout rates, as well as a recent rash of violent crimes involving teens.

Worthy has a new idea she hopes will fix the problem: Jail parents for up to three days for repeatedly missing scheduled parent-teacher conferences.

“I have seen that younger and younger children are committing more violent acts and we need to look at different approaches,” Worthy told reporters. “I know we need to try something different. We should not have to legislate this, but what we have been doing is not working.”

She’s still working on the details, but once her proposal is finished, she hopes to present it to county commissioners in August and persuade them to approve an ordinance. After that, she may take it to state legislators in Lansing.

It’s unlikely to quickly become an ordinance because it would probably be challenged in court because civil libertarians say it may be outside the law. Even some teachers, who often spend several hours waiting for parents who don’t show up for the conferences, are skeptical.

“I understand the prosecutor’s concern, but jail time?” said Detroit middle school teacher Ann Crowley.

Worthy first considered her proposal after a spate of shootings involving students that culminated in the June 2009 wounding of seven teens at a city bus stop. The Demarco Harris’ trial convinced her she was on the right track.

He had been in and out of school a lot and his parents rarely met with his teachers. Then came Aug. 1 2009 when authorities were investigating a killing.

“When police went to his parents, his parents were not able to account for his whereabouts and it was about 2 in the morning,” Worthy said.

Harris, who is now 13, was convicted in May of killing 24-year-old Trisha Babcock. He was sentenced to a high-security juvenile lockup.

“We’re trying to prevent any more Demarco Harrises from going down that road,” Worthy said.

Under her plan, Wayne County parents would be required to pick a time and day to attend one parent-teacher conference a year. If that conference is missed, the school would send out a letter to set up another within 14 days. If the second is missed, parents get a letter about sanctions, which could include up to three days in jail.

Parents with health concerns and those whose children are performing above average could be exempt. “I’m not interested in putting parents in jail if their children are high achievers,” Worthy said.

Currently attendance at parent-teacher conferences isn’t mandatory, and Worthy’s plan may be challenged because it could infringe on a parent’s civil rights.

“A criminal justice solution is not the answer to complicated social problems,” said Kary Moss, executive director of Michigan’s American Civil Liberties Union. “The last thing many families in dire situations need is more punishment by the criminal justice community. There’s established law already that governs child abuse and neglect, and that sets up the standard for involvement by the government in the family’s affairs.”

There doesn’t appear to be any existing legislation similar to what Worthy wants. She didn’t know of any and the National Conference of State Legislatures, which tracks state laws, didn’t know of one. Similar proposals in Texas and Kentucky have failed.

Republican Kentucky state Rep. Adam Koenig submitted a bill last year that didn’t make it out of committee. It would have required parents to attend at least one conference with teachers for each child in school. Failure to do so would have meant a $50 fine.

“I wanted to get parental involvement in the schools more attention,” Koenig said. “There’s a reluctance to fine parents who are often viewed as too busy. I’m of the opinion that there’s a lot of people who’ve paid taxes to have these kids learn. Parents have some responsibility.”

The 2007 Texas bill called for fining parents $500 and charging them with a misdemeanor for missing a scheduled parent-teacher conference.

Making sure Detroit students make it to school and stay there through the end of the day has long been a problem. The average student missed 46 days last school year.

Worthy’s office penalizes parents and guardians for school truancy. But by the time prosecutors get involved, large chunks of classroom time already have been missed. Hundreds of cases are reviewed each year, but only 50 or so result in prosecution. Educational neglect is a misdemeanor that carries up to 90 days in jail and a fine for parents. Older students could end up in juvenile court.

Derek Muhammad, who has a son in high school, has never attended a conference with a teacher, saying it’s hard to find the time while working. The 40-year-old said it’s also up to students to understand what’s required of them in terms of school achievement and positive behavior.

“Anytime you’re talking about a penalty that will take away the parent from the child who already is in trouble, then you have a very dangerous outcome,” said Muhammad, a motivational speaker. “There’s anger from the student, time away from the parent and hostility toward whatever caused that, and that’s the school system.”

Caught in the middle are teachers, who want to help students succeed, but struggle to compel parents to have the same interest.

Former Detroit special education teacher Emily Williams said it was disheartening when 3 out of 15 parents would attend meetings.

“Sometimes I would call home. Sometimes the phone was cut off. If you send a letter home, sometimes it wouldn’t get to the parents,” she said.

Instead of jailing parents, Williams suggests Worthy give them community service.

“A lot (of homes) are headed by single parents,” she said. “If momma is not coming home, who is going to watch the kids?”

    That quote is so true .. but in the same breathe you wanna lock them up .. smfh … There are plenty of single parents who work ridiculous hours and still find the time to help with hw, maybe a meeting here or there and their children do succeed..

You took the CONTROL away from the school as well as the parents and now you want to PUNISH the parent?     although @carolinagirl makes an excellent point, some consequence for failing to parent should be in place. jail is probably too much, but something should be done for force non-parents to *be* parents.

    the government needs to be more concerned about important issues like this than it does where we are allowed to smoke, what we are allowed to eat and similar invasions of privacy.

    This is a great idea. The reason things are as bad as they are is that no one is being held accountable. @ kashi101, hoodlums wont exist if they are taught that there’s something better. Your posibilities dont end with whether or not some one will hire you. We need to teach that. @ symphonee that’s not an exscuse I know teachers,counselors, and principals that gladly stay late to meet parents on their scheduals. In most cases there is a parent at home just unwilling to show up. We make time to do the things we want to do. Anyway there’s no excuse other than death that should keep you from being involved in these critical times of our kids life. All I see down here is excuses. We need to hold our kids and ourselves to a higher standard. The only way got to where we are today is because those who came before us held us to a higher standard than from what they grew up with.. We have to do better. To many people died just that we could even go to school.. And for the record there were a lot of things I didn’t want to do as a child but thought it was better to mind my parents than suffer their wrath..lol

    I agree, we need to hold parents more responsible! It starts at home first! As a toddler I was taught to say “Thank You”, Excuse Me” Can I please have”. I was taught to respect elders, it all starts at home! I see everyday all day children growing up themselves, living by any means necessary. Parents only in their 20′s and their children is already in their teens. I see children my kids ages 11 or 12′clock at night walking the streets, hanging out, smoking and drinking, and I asked myself “Where is there parents?”

    I agree 100%, put them in jail until the next parent teacher conference or 1000.00 fine. I am tired of all the blame being placed on teachers, when often times just a little bit of help from a parent would get the child above water. Only time you see a black parent at the school is when they argue, curse, assault, and or just act a fool, when their child is suspended from school or prohibited from playing football or basketball for lack of academic performance, this usually brings a dad, uncle, or mama’s current man around!!!!!! Put them in jail!!!

    I agree we need to hold parents responsible but I don’t feel they should be jailed. There are parents that do everything they are suppose to do and still the child does not do right. Some parents are just as bad as the children but locking the parent up will only do more harm. Some parent(s) would lose their job behind any prison time. What you need to do is start locking these children up. You don’t want to go to school, this is were you will be going to school. Take some of that taxpayer money build a jail schoold for those who continue to get in trouble. No you don’t go home everyday you go to you room. Build it just like a prison. Have teachers come to work just like to go to jobs at the school. At the end of the day only persons getting to go home is the teacher. Yes, you will be fed, breakfast, lunch and dinner in your room. yes, you will were uniforms everyday. No video games, cell phones for calling in/out not texting and block certain calls. Name the school Jail House Rock, School of Hard Knocks, School of Knucklheads…

    Jail is a little much, but I think this guy has his heart in the right place.

    Too many parents treat school like a daycare, as if they give up all responsibility once the kid enters the school. I think schools should take a lesson and FORCE the parents to take a larger role in their kids’ lives, if they are unwilling to do it on their own.

    And yes, I know that many of our parents are single or poor and need to work..but when it comes down to it, when they had that child, they made the decision to take care of them and try to give them a better life. Throw all the EXCUSES out the window. There’s only a TINY population out there who would get fired from going to a parent/teacher conference..everyone else is just unwilling to put forth the effort or lose the vacation time.

    Also, I’m sure this Prosecutor is only going after the serial offenders; parents with ‘troubled’ kids who haven’t even taken steps to visit the school or call to discuss over the phone. It is these people are doing a grave disservice to their kids, and the school on the whole.

    If the government didn’t take away the right to whoop these bad kids this probably wouldn’t have happened .These kids now have no fear because instead of an a$$ whooping they got time out(whatever)now they want to complain that kids have behavioural problems or rob, kill and do other criminalistic activities.Back in the day we didn’t do or even think about doing half the crap these kids are doing you know why because we knew we would get our butts tore up.My mom never had to have a teacher parent conference you know why because I was a good kid yes I had problems not saying I’m perfect but I knew how to act in school and in public.When I didn’t act right I got spanked not to the point of abuse but to the point of I knew I better not do it again.Thats what these kids need Discipline.Until that happens they will continue to run wild and commit various acts of crime because they grow up thinking the are untouchable and that is one of the main reasons our children are dieing so young or are in jail at a early age(some are in there for life at 17 thats a shame). Oh and yes I agree the parents need to be held accountable for their children too its not just the government it is the parents not laying down the law and enforceing it .just my opinion you don’t have to agree with it just putting it out there.

    Jail? Iam not so sure about jail for missing meetings. Yet,if my child breaks any law, I think I am responsable. In TX, if you child breaks a law,YOU,the parent/adult is held responsable. Even if you are under 17 ( 17 in TX) and you are a aprent yourself. Maybe folks will not let’kids be kids’. I say,beath that lil behinde.That way, we, society, and law enforcment will not have to suffer. It starts at HOME, at a very young age.

    When I was in grade school, my mother, who was at the time separated from her abusive husband, attended the conferences. She was a working mother caring for seven kids. The parent-teacher conferences were very helpful because the teachers informed her of our progress. As a result, she bought the appropriate learning aids to help us improve. Her involvement is the reason why we’re successful. Parents are making excuses not attending these conferences. They have to make an investment in their children’s future. I’m not sure if jail is the solution. However, a stiff fine is indeed appropriate.

    What CAROLINAGIRL said. That is the root of the problem right there – parents aren’t taking a chance on being jailed for administering corporal punishment in the home in the early years. Who needs the hassle associated with some cotton candy-soft a$$ teacher calling family services because Lil Johnny came to school talking about how he got that butt torn up last night?

    A few ol-skoolers like me will take that chance, but I can especially understand some single moms; especially if they have other kids.

    So Ms. Prosecutor, why don’t you retreat to the confines of your office and find a legitimate solution to the problem, instead of attempting to make a name for yourself on the backs of poor, underprivileged citizens? Take that same rhetoric to the other side of town where, truth be told, they have social ills with their children too.

    Their is no way to make a parent care about their kids. If the parents of that boy were to go to jail for anything it should be not knowing where he was at two in the morning. There is no solution to this, jail will not work because it will only make the parent/parents angry at the child. They will still not have the knowledge and tools necessary to make the child do better, they will probably just end up yelling at them which will just make the child more distant and angry. This all comes down to personal responsibility. When it gets so bad that you have to put a person in jail to get them to take care of their child then you know society is lost. I mean lets be real, you have to many people that were to young, or stupid, or reckless, or poor to be having children. And I do not mean to be rude but the ability to have sex does not mean you should have a child and people need to understand that. A child is a big deal and a person should really put down a foundationon of how they are going to raise and teach their child. But the fact is that alot of people out there are just making babies and then saying it is too hard. Do not blame on the drugs because you should know how to keep that away form your child, do not blame the hood because if it is that rough you should of moved before having a kid, do not blame the neighborhood kids because you should have more influence over your child, do not blame the money because you should of had a better job before you decided to have a kid; basically a person should have their s**t together before they have a kid. People now a days treat sex like hit or miss, like Vegas, like they did not know that was how kids our made. And the government has to come in and say,”you all are such bad parents that we have to put you in jail”, that is a damn shame. We have created an army of children with no parents, no sense, and alot of anger and now the government has to clean up the mess. And you know how the government is, once they get power over or in your life they will not let it go. We have set ourselves up for more control.

    Well Ms. Prosectutor should get the detroit board of education in order before any of this because we see that the person in charge is illiterate and can’t write a complete sentence and also masturbates during meetings. While yes some parents need to be held accountable because yes the teachers have to deal with kids who are unruley i do beleive everything starts with the home. But what about the parents especially single parents who can’t take the time off of work to attend the conference? I do think its harsh based on everyone has different circ**stances. A parent shouldn’t have to choose between going to jail or losing their job. I think parents should be more in communication with their childs school and teacher.

    I feel this is a step in the right direction. Out of an entire school year a parent can’t find ONE day to speak with teachers about their OWN child. We aren’t talking about day after day hours on end about someone elses child you could possibly care less about. This is their OWN child for goodness sake! Also the fact that there is wiggle room in the clause can cover the “I had to work/was at the doctor/ just didn’t feel like it excuses.” The parents get THREE chances. Something needs to be done, and hitting someone in the pockets usually works.

    @kajcohe-Hitting them where it hurt…you got to be joking. Parents with children are already hurting and single parents are hurting even more. Placing a parent in jail or even charging them a fine is crazy. When you got half a$$ teachers and school systems who don’t care if a child come to school or not muchless care about their grades. The parents nor the school has any control of the children…the state do and if anybody should pay its the state. They need to bring back the paddle to all schools. Starting from K-12 grade and give the parents their rights back and thats the only way you will be able to see any change. And when you got parents who work their job sometime want let them off to meet with anybody…the only time I know it want put your job at risk…if its death in the family and you have to show proof of that…if the job rates keep going up this prosecutor is going to have more than children doing crimes the grown ups going to be out there too.(JMRTY)

    The sad thing is that there is rarely an opportunity for parents to address wayward children. If you beat their behinds, you go to jail for child abuse, if you kick them out, you go to jail for child neglect and yet few cities have adequate resources to address wayward children. People can try and say make them mind when they are young and I agree with that. But some kids grow up and become pure hell raisers and so parents leave them to their own vices.

    I can understand the prosecutor’s concern and zeal, but obviously the jail time response is a knee jerk reaction and rife with constitutional issues. The fine idea is better, but a negative monetary incentive does not encourage good behavior. instead, why not take the money that would be otherwise spent on prosecuting deadbeat parents and offer that amount as a positive incentive to those same parents. That would make the fines more effective. But only offer the positive incentives for a short time – and hopefully the parents will see the benefits of accounting for their children.

    makes you wonder what happened to the good ole days when you had the right to raise your children as you saw fit. when i was coming up my mom had the right to whoop my behind where ever i chose to show out and our neighbors had the same right… it took a village to raise a child. now a days you have the children feeling as though they are on the same level as the parent. my children know respect is a two way street it must be given in order to be received. something went terribly wrong in the system, you now have some parents that are scared of their own children, there is no respect nor moral being taught in the home…all i can say is LORD HELP US ALL!
