Man Wrongly Docked $40,000 From Paycheck For Child Support

This time, it’s the city that’s the deadbeat dad!

A Brooklyn father is hoping for a rebate of more than $40,000 he has overpaid in child support since 2003, according to court papers.

Francois Jadotte contends that the city kept garnisheeing his wages — at the rate of $121 per week — even after his daughter turned 21.

“If you were in my place — you have been paying, paying for years, taken automatically out of your paycheck an overpayment — what could you have done?” asked Jadotte, an MTA signal maintainer who says his budget is at the breaking point. “I am tired, miserable, lonely and poor, working desperately to survive.”

The snafu dates back to 1985, when Jadotte and his wife, Jocelyn, divorced. Ten years later, Jocelyn went after him for support for herself and three kids.

The court ordered support only for the oldest of the children, Maybell, the one born before the couple divorced. The others — born after — could not be proven to be Francois’ offspring.

    I dont know how you let something like this go on for so long that it acc**ulates to 40 grand..that’s just crazy. I agree. He didnt put much effort to get this resolved much sooner. And the trifling wife knows she wasnt suppose to be getting it so she shouldve been decent enough to give it back to him. I hope he gets something back, he more than held up his end of the bargain.

    Before we comment…. The Child Welfare act of 1997, Signed into law, President Billy -boy Clinton empowered states to massively increase the power of government to levy and tax income of debtor parents, as well to, limited the rights of the debtor parent!! Issue charges of Felony of the 3rd degree, per child for failure to comply, writ of arrest {interstate}, federal employment tracking, command and control interstate driving privilege(s), writ of domain seize (take your house from you and sell it). Up to 70 percent of the debtor gross income can be seized (funny…your taxes deducted, equal 37.9 % of your income) bottom line you don’t have any rights!!!

    1999… The Supreme Court of The United States 9 to 3 vote up held the law as constitutional. Only Clarence Thomas, wrote about the injustices of the law, 10 pages of no no no!!!, He voted un-constitutional..gee you folk here @ BP call him “Uncle Tom” , I wish black people would read the book “Uncle Tom”, you’ll find out that.. Tom , the slave, was no sell out, a religious fool, yes!! A sell out no!!! (that’s what cost him his life)

    Child enforcement agencies have unlimited power, there decisions are final and only the Supreme Courts of the respective states can override them…This man do not have the monetary strength, to wage war with a CEA, at that level (this was done on purpose,via CWA of 97, Hillary wrote this bill, and that why she dangerous!!)by seized income at 50%, he too broke to fight them!!!

    That one issue , why 40 plus % black women are not married. If the marriage don’t work out, got kids, you’ll be pushing a shopping cart full of plastic bottles and aluminum cans!!! So the CEA over task him, they do not have to give any of it back ( they consider it a gift to the children) and if there is a refund the pondage (there handling fee, 3% of monthly take) will not be refunded… So get off his back!!!

    The system is flawed, and unfortunately I don’t think anyone is going to fix it. This man should get ALL of his money back in one lump sum. And her ass should have her wages garnished as punishment. Child support is so f**ked up it’s not even funny. Most of these women file for child support only when the man no longer wants to be with them as a way of getting even. And they use the money for their own personal reasons, not just the kid.

    there a plenty of men who have payed and are paying child support for a kid(s) that’s not theirs. my friend was having his pay garnished and finally got the girl to agree to a paternity test and the kid wasn’t his. he calculated it to be $10k and the judge told him she was sorry but he wouldn’t be reimbursed.

    the broad admitted to him she knew he wasn’t the father but wanted him to be becasue he was a good man.

    you people are unrealistic…. when a man goes before a magistrate in New York state you get treated like straight shyt! They treat you like a criminal even though you are in a family court. Then, you are alone. You are standing before the judge ALONE… to answer someone else’s allegations.
    When a woman goes before a judge it is assumed that she is the one in the right! Meaning that the man is wrong.
    So what about the woman, she should be prosecuted for accepting money that isn’t hers….and why is it that we are supporting children over 18??? When I was 18 I was a soldier. And at 21 I was a college student, with a job!

    I FULLY agree with Anthropological! That goes for ALL court systems!! Women are ALWAYS treated as ‘Right’ and Men (especially GOOD Men) as ‘Wrong’ right off the DAMNED BAT!! I once saw a Man in court for ‘Raping’ his own Wife!! And SHE was there to drop the charges because she admitted that she only had him arrested for Rape to get back at him from a previous disagreement they had!!     How much longer are we going to accept things like this. Not only is this another example of too much government, it is another example of too much bad government, and we’ll go on about our lives thinking nothing of this, and being thankful that your government chose not to pick on you today. The constitution was to protect us from bad government. He dont need a bunch of money to fight this, what he needs is a strong voice, and a large enough collective of like-minded individuals to decide that this is something worth fighting against. Our minds have become so distracted by worthless music and empty television, that we forgot that fighting for your basic rights is the ultimate entertainment.

    This story is one of many across the US. What is even more worse as some individuals have already explained in some states a man is still made responsible for a woman’s children even though they may not be his children biologically because DNA said it was not his children. If he is the only one working and he has been taking care of those children some states still consider those children as his and the state of Kansas is one state that practices such methods. The government does not care who they get the money for to take care of the children as long as their not the one’s fitting the bill. It is ashame that the man’s ex wife did not alert the government to what was going on but why would she she is receiving free money without having to lift a finger. I really think the child support system is set up to fail a lot of men especially black men. Now, what is even worse is what if this man would have stopped working or paying his child support the same system that was taking his money faithfully would have locked him up or suspended his driver’s license but why when he should have been taken off of child support what a messed up situation. I wanted to say @Waisa32 I agree with you on many levels when it comes to men who don’t pay their child support for whatever reasons when they are ordered to pay child support but that is a whole other topic of conversation.

    They keep taking out of my check too after I have paid,I am not behind and they take a extra payment out of my check every month. Then they hold my taxes saying that I owe but when I ask how, they just say we don’t have it in our system that you owe. I wouldnt care about the extra payment if my kids got the money but they don’t so where is the money??

    This is really not uncommon, as Diva pointed out. My friend put her man in the system, and he was paying until 1 check came late. He had an E-Trade type account set up with 10K in it and they TOOK ALL OF IT! He owed like $500! How can you take his whole account? Then there is the case of dudes who get with women who already have kids, they split, then the woman comes at THAT guy for child support, and get back payments in the thousands, for kids that aren’t his. THAT is a huge problem.

    This sounds like a dumbass. A month before the last payment was garnished, he should have been in the child support office with the doc**entation showing that the child is 21. Don’t wait on them to cut that child support off, there are too many people in the offices to know what the left hand and the right hand is doing.

    The people that is stealing this money from you all is a secret society that has tapped into the databases of African American men that has, still or at one time still owes back child support, It does not look at SSN, it looks at names only. It is only concerned with a name and a name only. They take your money and it is left up to you to fight to get it back. This society knows that it is covert in doing what they do because they know that as soon as the men that are paying Child support get of this, that is one wheel that they cannot stop.
    If you owe pay it and get out of the system.
    Now for all you women that have lied on these Brothers for no reason, Hell is not full and you will get yours for the lies that have been told by you.
    No, I am not a part of this mess, but I can tell you some stories of guys who have been accused of being the Baby Daddy and when finding out that they are not did in fact fill those women’s live with hell through lawsuits.

    i am soooo tired of men who are fathers getting railroaded by the “justice” system… she should be sued for accepting the money and not notifying the govt, and the govt should pay back the money with interest for not stopping the payment once the child was 21. s**t like this make me sick. i would not dream of doing that, it just isn’t right. i have a friend who the court is trying to make pay child support when the child isn’t his. the chic is back with the biological father, amd STILL they say he has to pay???     This is sad but there are some men out there who feel this may be happening to them also. My dad is still paying and all 3 of his kids are over 20. This is he has to pay back all that back childsupport. He is just not paying for those years when my mom alone had to find money for school clothes or food. Just because your child is 18 doesnt mean its all over. If you were ever late the goverment will keep record of that and you will have to repay. For this man though, it is a shame and the mother of his children is in the wrong.

    In this case any man or woman still paying child support should sue the state to get the money back plus for suffering through hardship. This man’s ex-wife was really greedy because they only have one child and she demanded child support for three! I can not stand woman like her if she knew who the father was why she fronting those two were her ex? I hope the birth control for men that is being created now come out because I am tired of these stories. It take two to tango but it also take common sense (both parents) not to put one self in situation that will cause problems in the near future. At the end of the day it is the children that suffered the most.

    When his daughter turned 18/21 he should have filed for emancipation. The courts do not automatically stop taking it out of your pay, once the child is of age. You have to go down and let the courts know…”Hey it’s about that time.” Also, if his daughter was in college then he would have to pay until she was out of school. It’s sad that the rules are not thoroughly explained to people.
