I have been actively involved in the fight for Heather Ellis, the 24-year old school teacher who faced up to 15-years in prison for cutting line at a local Wal-Mart.  Although Heather has now reached a plea deal with prosecutors over her arrest, there are still questions that need to be answered.  No, she was not charged with cutting in line, but it was the cashier’s reaction to the alleged line cut which led to the relevant sequence of events.  Had the cashier been more professional and not refused to serve Heather, none of this would have happened (You hear that Walmart? Perhaps that’s why your attorneys are telling you to remain silent).

I have five simple questions about the trial of Heather Ellis:

1) If “no one was seriously injured,” why was she facing up to 15-years in prison?

In the opening statements of the trial, the prosecutor in the case, Morley Swingle (the dandy fellow with the Confederate flag on the cover of his book) stated that “There was no serious injury, but it did hurt,” when referring to the alleged assaults committed by Ms. Ellis.  If no one was seriously injured, does that constitute a Class-C felony?  This statement was quite telling when it comes to understanding the style of justice being administered in the Southeast Missouri area (which is why we are sending our reports to the Justice Department after the trial is over).  Given that Ellis appears to have been the only person to go to the hospital after she allegedly beat down all of these great big men, it would seem to me that perhaps she might be the one who is able to file an assault charge against the officers.  Additionally, the defense attorney on the case, Scott Rosenblum, presented evidence in court of there being blood in Heather Ellis’ jacket pocket from the night of the incident.  This would be consistent with her claim to the doctor the next day that she was assaulted by the police.

2) Why did the prosecutor hype up the videotape?  Was he lying?

When Stephen Sokoloff, the original prosecutor on the case, first felt the light shining on his little town, he became defensive.  As proudly as he could, Sokoloff claimed that the release of the video of the incident would show that Ms. Ellis is not as innocent as she claims to be.  The video has now been released and shown to the world.  Anyone in their right mind who watched the Walmart surveillance video taken the night of Heather Ellis’ arrest would have been sorely disappointed.   There was almost nothing on the video, other than a clip of Heather moving someone’s items off the conveyor belt (not punishable with prison time), and her walking out of the store with the officers following her.  The more the facts unfold in this case, the more it appears that there may have been an assault and cover-up.  My father was a cop for 25-years, so I know that officers stick together, especially when they think they can get away with it.  The Kennett police have some explaining to do.

3) If Heather was the aggressor, why is she seen on the videotape leaving the store?

The videotape shows Heather Ellis leaving the store with her cousin, with an army of police officers aggressively pursuing her.  This contradicts the officers’ account in a couple of ways: First, it does not seem to support the claim that Heather refused to leave the store, since she is clearly walking out the door on her own free will.  Secondly, it doesn’t support the idea that she was determined to “beat the ass” of the police officers (as some have claimed), since it would seem that she wouldn’t say, “follow me outside first so I can beat your ass.”  I would imagine that anyone determined to “beat the officers’ asses” would have done so right there at the register.

4) How can you go to trial in less than a week on a case that was given to you by someone in an entirely different office?

Dr. Christopher Metzler at Georgetown University, one of the most respected attorneys in the nation, questions the idea that a prosecutor can come from another town, take over a case and be ready for trial in just one week.  According to seasoned lawyers I’ve spoken with, the only way this would be possible is if someone else were guiding the new prosecutor behind the scenes.  I wonder what Stephen Sokoloff, the original prosecutor who recused himself from the case, has been up to this week?  Swingle could be getting some influential back up.

5) Why has this case been made to be about Heather’s cursing and allegedly “lewd behavior”?

I find it quite interesting that as this woman faces up to 15-years in prison for a minor incident, everyone is focused on the fact that she allegedly cursed at the officers and the cashier.  The question, to me, is not whether or not she cursed.  The question is whether or not she deserves 15-years in prison for getting angry.  I am not sure if Heather Ellis was mean to anyone that night, but in a fair justice system, the punishment must fit the crime.  So, to those who feel that she should have simply behaved herself, take a second to realize just how silly you sound.  Cursing or getting angry does not warrant the theft of a young person’s future.  If that were the case, the George Bush’s of the world would have gone to prison a long time ago.

As I mentioned at the start of this article, Heather has reached a plea deal.  But the freedom of Heather Ellis does not negate the effect of overzealous prosecution of people of color.  Heather’s case is not the end of anything, it is actually the beginning.

    Wow. Dr. Watkins, for shame. You’re grasping at straws now that Heather accepted a plea deal before winding up with felony convictions. Despite all the hype on the site, there must have been an understanding at some point that this was a no-win situation for her. Hopefully she will learn a lesson from this. Perhaps you will as well.

    1) If “no one was seriously injured,” why was she facing up to 15-years in prison?

    Because she was charged with a felony that had a maximum potential sentence of 15 years. It is disingenuous to suggest that Heather faced an actual sentence of 15 years. As you well know, she was a first time offender and her sentence would probably have been similar to what she wound up with. She could have saved herself and the rest of the nation the trouble by owning up two years ago.

    And bringing up the book the prosecutor wrote, the one about the civil war. Yup, way to tug at those racial heartstrings. You do a disservice to your people.

    And as for the last minute evidence: Was the blood tested? Was it Heather’s? Was it perhaps from one of the police officers? Why did the doctor who examined her say that he found no evidence of abuse beyond bruised wrists? It is not true that bruised wrists can be caused by struggling, fighting, and resisting arrest?

    2) Why did the prosecutor hype up the videotape? Was he lying?

    I think it showed exactly what it needed to show. By crying racism Heather put forth the idea that she was an innocent victim who acted like and angel but was still abused by the mean whites. In truth, she lost her temper, acted unreasonably, and ultimately acted so out of line that the police were called.

    I’ve gotta quote this, because I can’t honestly beleive you wrote it:

    “My father was a cop for 25-years, so I know that officers stick together, especially when they think they can get away with it. ”

    So then, how many racially motivated crimes did he cover up during his years on the force?

    3) If Heather was the aggressor, why is she seen on the videotape leaving the store?

    Correction to your slanted statement. Heather was being ESCORTED from the premesis. Big difference. Had she stopped, she’d have been arrested. She apparently stopped, perhaps to continue arguing with the officers.

    4) How can you go to trial in less than a week on a case that was given to you by someone in an entirely different office?

    Simple. This was not a complicated case. A first year law student could have effectively prosecuted this case. There was a video tape that showed Heather was agitated enough to repeatedly abuse a customer and the clerk. There was not a single witness who could corraborate her story, other than her family members. There was no physical evidence to back up her claims of police brutality. There is nothing other than her word against he word of a dozen or so other people.

    5) Why has this case been made to be about Heather’s cursing and allegedly “lewd behavior”?

    No, the question is whether she deserves 15 years in prison for resisting arrest and assaulting police officers. You continue to assert that this case was entirely about race, or the prison sentence, or something else besides Heather’s behavior. Think for a moment and realize just how silly you sound.

    She acted abhorrently. She resisted arrest. She committed crimes. Period. She was offered plea bargains. She insisted on a trial. She did so publicly. She did so using racial tension as her lever. I’m sorry, but I see no redeeming features there, Doc.

    The freedom of Heather Ellis will not negate the effect of overzealous race baiting either. Imagine all of the time, money, energy, and talent wasted on this charade. It is disgraceful. And the result will likely have a generational effect and contribute more damage to race relations than it has any right to. It was a tiny thing, and she is a tiny person. For that matter, though you try very hard, it’s tough to play the moral high horse when you’ve acted so reprehesibly yourself. It makes you look stupid.

    this is why legit racism cases credibility are questioned. i saw a report on this last night and the wht lady (wal-mart mngr)told the truth. they way it was described is believeable becasue i’ve seen it before from some loud mouf broads in the store!

    The point is she was wrong in her behavior and she should have insulted walmart by not buying their s hit and contacting their corp office to report the treatment she received.

    I know people who live in this area. What is so crazy to me is that there are people who don’t know jack about racism and in spite of all the statistics to the contrary, refuse to believe that this could happen to this young woman. I am glad that there is a professor who is not afraid to take a stand for a young black woman. We need more of this in America.

By doing things like this all your doing is seperating African Americans from all other races by making us look so dumb and no one is doing it but yourselves. Stop! It’s so unfair to good people like President Obama who has tried to do some of the greatest things this Country has seen as President. Next time ask yourselves: What would Obama do? I can tell you if Ms. Ellis would have done this she would not be in the position she’s in.

    Dr. Boyce Watkins is a race-baiter. He won’t admit that he was wrong in supporting Heather Ellis, just like she won’t admit she was in the wrong at that Walmart in Kennett. When it comes down to it, there are now more racist black people in America than there are white people. I’m not sure if they can’t get over the fact that
    a) there used to be horrible practices like slavery and segregation in America, or
    b) as a whole, they haven’t been as successful at bringing their people above the poverty level as other immigrant groups flourished in a generation or less.

    If they put as much effort into doing the things Dr. Cosby was talking about that they do race-baiting, complaining about trivial things, and trying to find racial injustice around every corner, perhaps things would be different for them. Instead, these African Americans that are apart of the modern day civil rights movements are quicker to point a finger at any white person than they are to actually investigate and get down to the bottom of it. When Sharpton or any of these cronies say “We’re looking into this”, they never mean that they’re investigating the incident…they’re trying to find out how much exposure that case is going to give THEM, and if they feel like it will be beneficial to THEM, they jump on the wagon. Race-baiters are an evil that need to be stopped, and the way you fight them is to bring as much attention to the truth as they do their BS. Be careful when you do that though, because if anyone marches against them, they bus Klansmen and skinheads in to join you and take a bunch of pictures of you and say, “see? These people are racist. That’s why they’re standing against us! It’s not because they’re right, it’s because they’re afraid of a strong black man.” They’re so afraid of losing they cheat to win.     It’s obviously some people are missing the whole point about this individual black woman Heather Ellis being sentenced to 15 years. It’s not about Obama or her representing the whole black population or making us blacks look bad because as black individuals I’m sure there are some who can take being black to a whole new level period but those are individuals period.

    What this whole case was about was unequal justice they were willing to give her 15 years for alleged allegations that were filed against her, resisting arrest, assault upon an officer, failure to lead private property,

    Yes her behavior was unbecoming of a lady but do you think she should had been sentence to 15 years as a first offender, no history of violence, no arrest record.

    thank god she didnt have to have a jury trial I would hate to imagine the type of people her faith would have been left up to especially if they had one track minds and did not seek to equally enforce justice like these chumped up charges.

    Dr Watkins – Your path frightens me…. You profess to want to improve black/white relations. In evaluating your writings, you just seem to be an angry black man to me….. You cost that town two million dollars in police protection. What did you acheive from that? What did the town acheive from that? The money would have been much better spent, and gone much further if it had been used for some type of racial improvement. It’s time we bring people together, not continue to seperate them.     This nonsense should have never gone to court! I can understand whites not giving a d*mn about a black person being wrongfully persecuted; for 100′s of years they’ve hung black people for little more than just being black – it’s historical fact.

    What I don’t understand is why black/African people in general do not understand the gravity of the situation they are faced with? They experience racism at their job, racism when applying for an apartment/house/college, they see white supremacy flare up in the news with police brutality, and laws to curb their rights, yet blacks/Africans remain in willful ignorance and cowardice.

    Though you have been the victim systemic generational oppression by whites; begging them to see your humanity or going along to get along is not working. Logically you can’t insist on doing the same things and expect different results.

    Progress can’t be measured in you now having the “privilege” of dating/mating with whites. It can’t be measured in getting a job that can just as easily be taken away regardless of your education, or measured in the lack of burning crosses in your yards. Black/Africans have to do for ourselves by working with ourselves. Anything short of this will be subjugation as it’s always been.

    What was done to Heather Ellis is a crime.I too have first hand experience of this type of RACISM. I am shocked by the comments of some bloggers who ask Why she accepted a plea deal or assumes guilt because of her plea deal. Would you rather serve lon time prison time for a crime you did not commit or accept a plea deal usually probation, anger management and fines. You will realize that there is no fairness in the criminal justice system. I was told by my attorney when a black person steps inside court they are automatically perceived as guilty of something. Whilt this disturbed me and I was familiar with whites perceptions of persons of color., What was even more shocking was that blacks perceive blacks as guilty. I will never forget how the blacks on the jury panel and particularly the black jury foreperson scurried out of court like rats. Racism is alive a well, do you really think it is fair to give someone 15yrs for cutting line or some type of perceived assault (yelling, cursing, alleged altercation?). lawyers hands are tied by judges. some lawyers are no good and do not adequately defend a person of color.When are black people going to open their minds and see this racial BS for what it really is? CONTROL. I feel the comments of millerboypsycho513 (You got it right).
    Only when we say enough is enough and boycott will america see our point of view. Too many blacks have the hear-no-evil, see-no-evil, speak-no-evil mentality and need to wake the f-up. I feel for Ms. Ellis because I been there and I know cops and attorneys will stick together to create a crime. I will be glad when someone in the Dept. of Justice or Someone in the whitehouse has the balls to investigate crimes that all have the familiar key tags-resisting arrest, assault, uncooperative. persons of color are treated like crap everyday and no one cares. Kudos for Dr. Watkins for trying to enlighten, but some blacks will never see the truth.

When Issues are not spoken too and dealt with they will get out of hand. With regard to Heather Ellis situation, where is Al Sharpton, Where are Jesse Jackson? Where are the comments of our black leaders????

    YOUR lawyer/attorney + the Prosecutor + Judge are all members of the ‘BAR’ asociation AND they are all employed by the same corporation called “THE STATE OF CALIFORNIA/NEWYORK/etc” (or whatever state you’re in). thus their first obligation is to themselves.

    plus Courts and prison system is a money making machine.

    a REAL CRIME means a real (natural) person was harmed and/or property was stolen/damaged.

    This story is absolutely horrifying! It is a true picture of the unjust monster that is our justic system, however, as I read the comments, I am disturbed! All these comments talk about how white people “see” black people as guilty and how white people treat black people differently. Perhaps it is possible that our system is simply unjust to all! Not to black or white or any other color of the rainbow, but just a flawed system. I am a 28 year old white woman from a small midwest town, so perhaps I am not “wise” to the way things are in larger cities, but I do know that where I’m from 99% of people see no color! We look at a black person no different than we look at a white person or hispanic even though until 10 years ago there was perhaps one black family here. I feel honestly like some of the comments here are derogatory to white people, which bothers me because I would NEVER speak that way of another race because that would be racism and racism is the most ignorant belief a person can have, so on half of all the SMART white people in the country I resent the comments being made! We should work to fix the justic system! This I know for sure and from first hand knowledge, however, we should work on is a country not as a group of black people or a group of white people but united to make the justic system fair for all Americans.
