An Arizona woman is taking the Chandler Police Department to court after she was ambushed in her home by police and arrested minutes after getting out of the shower.
According to the New York Daily News, Esmeralda Rossi was home with her daughter when Officer Doug Rose knocked on her door responding to a domestic argument between Rossi and her estranged husband. Rossi says her daughter answered the door and let her know an officer was there. After stepping out of the shower to speak to the officer, Rossi admits she was defensive as their conversation went on and asked the officer if she could grab her phone to record it.
Things took a turn for the worst when the officer illegally followed Rossi into her home and grabbed her arms, leaving her towel to fall on the floor. Rossi, who was molested as a child, says the incident brought back haunting memories from her past.
“I turn to go into my living room, and I probably get about five steps in and all of a sudden, I just hear boots running in after me, telling me, ‘Stop or I’ll arrest you!’” she told the TV station.“I was in the shower! What is wrong with you?” Rossi screamed, her towel slipping off of her body.
“When I was standing there … I felt like I was 7 all over again in a dark room with a man that is just staring at me.”
Her daughter grabbed the phone as the cop lectured her for twenty minutes about her behavior as she sobbed. Rose left the home without officially arresting the mother of one.
“Don’t take the attitude with cops, because we don’t play,” Rose said. “When a cop shows up, you’re not the one in charge. I don’t care if this is your house.”
An investigation was launched, determining Rose was guilty of trespassing Rossi’s home, but he was able to quietly retire from the force and collect his pension. Rose’s police report also left out key details of the arrest including the reason behind it, the fact that Rossi was naked and his illegal enter of her home.
Rossi is now suing the city of Chandler, Ariz., for the aggressive invasion.
