Terence Crutcher reportedly was high on PCP when he was shot last month after calling police for help when his car broke down in Tulsa, Oklahoma, reports the New York Daily News.

The report released Tuesday by the Oklahoma State Medical Examiner’s Office showed the 40-year-old Black, unarmed father “had ingested PCP and another hallucinogen called tenocyclidine, or TCP,” the report says.

Coroners also ruled that Crutcher died of a gunshot wound to his chest and listed his death as a homicide, notes the report.

An attorney representing Crutcher’s family called the medical examiner’s findings unfortunate, but said it does not change the facts of the case.

“[The] toxicology report does not change the most pertinent facts of this tragedy: [Tulsa] Officer Betty Shelby shot and killed Terence Crutcher who was unarmed and had his hands up, without provocation or justification and she should be held accountable for her unlawful actions,” Damario Solomon-Simmons wrote in a statement released to NewsOne.

“Furthermore, Terence was so much more than this issue,” Solomon-Simmons continued, “including being a devoted father, a college student, and a great gospel singer, he was working hard to better his life and the life of his beloved children when he was gunned down on his way home from class.”

Shelby, 42, a White police officer, was charged last month with first-degree manslaughter. She reportedly was overcome with fear that Crutcher, who failed to respond to her commands and was walking away from her with his hands up, was going to kill her.
