He (Michael Mineo) also was asked to inspect the boxer shorts he was wearing at the time. There were two holes – one allegedly from the attack, and another where material was removed for forensic testing.
“Uh-oh, who made that second hole there?” Mineo said quizzically. Then, in a bit of odd phrasing that the defense might seize on, he added: “I didn’t do that. I didn’t make two holes.”
Kern’s lawyer, John Patten, also asked Mineo to replicate the blood-curdling scream says he let out when the attack occurred.
“Come on, this is ridiculous,” Mineo yelled through the courtroom. “Is this your defense, is this your best defense?”
