Jene Newsome played by the rules as an Air Force sergeant: She never told anyone in the military she was a lesbian. The 28-year-old’s honorable discharge under the “don’t ask, don’t tell” policy came only after police officers in Rapid City, S.D., saw an Iowa marriage certificate in her home and told the nearby Ellsworth Air Force Base.

Newsome and the American Civil Liberties Union filed a complaint against the western South Dakota police department, claiming the officers violated her privacy when they informed the military about her sexual orientation. The case also highlights concerns over the ability of third parties to “out” service members, especially as the Pentagon has started reviewing the 1993 “don’t ask, don’t tell” law.

“I played by ‘don’t ask, don’t tell,’” Newsome told The Associated Press by telephone.

“I just don’t agree with what the Rapid City police department did. … They violated a lot of internal policies on their end, and I feel like my privacy was violated.”

The “don’t ask, don’t tell” policy has come under renewed debate after Defense Secretary Robert Gates called for a sweeping internal study on the law earlier this year.

As the review is under way, officials were also expected to suggest ways to relax enforcement that may include minimizing cases of third-party outings. In particular, Gates has suggested that the military might not have to expel someone whose sexual orientation was revealed by a third party out of vindictiveness or suspect motives.

The Rapid City Police Department says Newsome, an aircraft armament system craftsman who spent nine years in the Air Force, was not cooperative when they showed up at her home in November with an arrest warrant for her partner, who was wanted on theft charges in Fairbanks, Alaska.

Newsome was at work at the base at the time and refused to immediately come home and assist the officers in finding her partner, whom she married in Iowa – where gay marriage is legal – in October.

Police officers, who said they spotted the marriage license on the kitchen table through a window of Newsome’s home, alerted the base, police Chief Steve Allender said in a statement sent to the AP. The license was relevant to the investigation because it showed both the relationship and residency of the two women, he said.

“It’s an emotional issue and it’s unfortunate that Newsome lost her job, but I disagree with the notion that our department might be expected to ignore the license, or not document the license, or withhold it from the Air Force once we did know about it,” Allender said Saturday. “It was a part of the case, part of the report and the Air Force was privileged to the information.”

He said his department does not seek to expose gay military personnel or investigate the sexuality of Rapid City residents.

Allender said the department was finishing its internal investigation and has determined the officers acted appropriately. They have not been placed on leave during the investigation.

Newsome’s partner is currently out on bail on one felony and three misdemeanor counts of theft stemming from an incident last year, court officials in Fairbanks said. More information was not immediately available, and Newsome said she didn’t know the status of the case and didn’t provide more details about it.

In the complaint filed last month with the department, ACLU South Dakota said police had no legal reason to tell the military Newsome was a lesbian and that officers knew if they did, it would jeopardize her military career.

Newsome, who was discharged in January, said she didn’t know where the marriage license was in her home when police came to her house on Nov. 20 and claims the officers were retaliating because she wouldn’t help with her partner’s arrest.

“This information was intentionally turned over because of ‘don’t ask, don’t tell’ and to out Jene so that she would lose her military status,” said Robert Doody, executive director of ACLU South Dakota. The ACLU is focusing its complaint on the police department, not the military, and Newsome said she and her attorney have not yet decided on whether to file a lawsuit.

“The ‘don’t ask, don’t tell’ piece is important and critical to this, but also it’s a police misconduct case,” Doody said.

A U.S. Air Force spokesman, Senior Airman Adam Grant, said Ellsworth follows all laws set out by Congress and the Defense Department, and he would not comment specifically on Newsome’s discharge, citing privacy policy.

More than 13,500 service members have been discharged under the law since 1994, according to the Servicemembers Legal Defense Network, which is lobbying for its repeal. Kevin Nix, communications director of the Washington, D.C.-based nonprofit, couldn’t speak about Newsome’s case, but said when “someone is outed by a third party, which it sounds like this was, or by a police officer, then, yeah … I’m not surprised the person was discharged.”

Though rare, third-party outing can be especially damaging to service members who wanted to keep their sexual orientation hidden, experts say.

Even though 80 percent of “don’t ask, don’t tell” discharges come from gay and lesbian service members who out themselves, third-party outings are “some of the most heinous instances of ‘don’t, ask, don’t tell,’” said Nathaniel Frank, a research fellow with the Palm Center think tank at the University of California, Santa Barbara and a New York University professor.

Newsome, who is originally from Harrisburg, Pa., is currently on the road, driving to Alaska. She said she’d been looking forward to the time when the military would alter its policies regarding gays and lesbians. But that change didn’t come in time to save her career.

“I felt like it was getting close,” she said. “I was really hopeful.”

    A marriage license is a public doc**ent and everyone in the US has a right to know what public licenses and privileges a person has. A marriage license is NOT a private doc**ent.

    Secondly, she has a marital obligation and relationship that she did not disclose to the Air Force. That is quite beyond don’t ask, don’t tell. She “told”, the moment she took that marriage certificate. She also entered a legal obligation of some magnitude, without informing her superiors. When I was in the military, you were not allowed to marry without permission of your NCO.

    Thirdly, she was refusing to co-operate with authorities in a criminal matter. The reason she was refusing to co-operate was that she was attempting to protect her spouse AND to conceal her relationship from the Air Force.

    Now, what would her reaction be to a terrorist of some sort or another, asking about security information and if she doesn’t provide it, they’ll find a way to have the Air Force find out?

    Now, some will say “Well, that’s a good reason to eliminate the policy”.

    Well, that’s not how the military functions. The military functions by having the maximum number of individuals falling within various degrees and areas of functionality, and thus UNIFORMITY. Thus, it’s contrary to that function for the military to change in order to suit a few…

    Well some states offer sealed marriage license which are not public information so if she could prove up that than she and her attorney have a very valid complaint against those azzho’s.

    Well one would see how long the don’t ask don’t tell law would have been in effect if it as used for and against politicians in office I bet they’d changed that law in a second to suit them.

    I’m sorry XL_611, i’m going to call B.S. on this one. I was also in the military and no one had to ask permission to get married, if that was still a tried true practice, 2 of my soldiers wouldn’t have married strippers after one week. You must have been in during vietnam or something. There are many practices that the military will change to suit specific needs. This is the new military. I was also and NCO in the military, even me being an NCO shows that times have changed. Women weren’t even allowed to be in the military unless they were nurses, but as you and I both know, women do a lot of different jobs now. I was chemical recon myself and that involved me being with tankers most of the time (male only mos). There was a time when blacks were not allowed to join the military. The courts give you an option, at times, to either go to the army or prison, this shows me how much “tradition” matters to the military. Peoples records get sealed and waivers are given. These cops were trying to “get back” at this chick, plain and simple.

    You both make some valid points, but I think in the end the winner goes to XL, you are right about not alerting the military on your personal status which is required for readiness purposes.

    Remember a month or two ago when the young female in GA came up on the radar late in the process saying she could not deploy because she had a child and no care plan.

    That is the obligation of a service member to the service.

    People remember, the duty in the military is just that. Much like jury duty, it is a service that serves the interest of the Nation and not a career privilege that serves the interest of the individual.

    The young lady’s situation with the family care plan and this situation about someones sexual preference are two different things. Like apples and oranges. The young lady with the child was about to deploy and didn’t have anyone to take care of her child, this young lady is just having sex with another female, I don’t see how that is something that needs to be reported to higher ups. If that was the case, sodomy is also outlawed in the military so anytime a woman or man receives oral/anal sex, that must also be reported to their commanding officer. People pick and choose the things they want to enforce, just like people do with the bible, thats all i’m saying.

Secondly, she shouldn’t have been caught up in a situation with someone, married or not, that puts ur moneymaker at risk. Now u without a job and ur wifey can’t get one.     OMG, the intolerance, ignorance, negativity, and pure stupidity in these posts amazes me. I didn’t know people could be so downright rude and evil. She complied with the don’t ask, don’t tell policy, and for them to out her for not cooperating out of spite was wrong. If i had my law degree already, I swear, I’d track this lady down and offer to defend her, I’d take NO money if i loss the case, and a meager fee if I won, but I’d offer her the best counsel I could, cause cases like this are wrong, and she deserves justice for the department’s actions. I’m not condoning her non-compliance with the police, but their subsequent actions should be punished also.

    I feel as though she was victimized by law enforcement. It really is sad how she was discharged, despite the fact she played by the rules and was an outstanding nco. No one knows why she couldn’t leave work. Maybe SHE HAD OBLIGATIONS TO FULFILL before she left. Maybe she had to speak to one of the higher ups and explain that she had to leave. I am skeptical that the officers “saw the license through a window.” Looks suspect to me…. The chances of the license being on a table and LEGIBLE from a window are slim. I didn’t say IMPOSSIBLE, just VERY SLIM. I see soldiers at work everyday that eff up constantly and they somehow manage to retain their ranks and positions. I’d sue the dept and hopefully things will work out for this young woman. All you haters down there can sdfu. Real soldiers don’t discriminate based on s–t like that. We go for quality and performance, not what goes on in everyones bedroom unless there’s abuse or questionable activity (I. E. Drugs, excessive or underage drinking, abuse, assault, etc). I’ve seen soldiers marry the worst people in the world and no one knew about it. Or, if we did find out, it had already run its course or what have you. Policies have drastically changed in the military today and many ignorant people fail to realize that. I hope she takes them for everything she can get. Good luck sgt.

    All marriages and divorces are public matters and filed in public offices, none of which are sealed. A “sealed” marriage certificate refers to a seal stamped on the doc**ent.

    I’ve looked for sealed marriages and found nothing of the kind.

    Thus, she made public her sexual orientation, just not to her superiors.

    DADT,means don’t tell anyone about such activities. If you do tell anyone, you obviously run the risk of someone else finding out, intended or no. You can’t have it both ways.

    Lastly, this is the very reason homosexual behavior has always been considered to be corrupt. It always leads to the corruption of any variety of situations.

    In this case, she’s presenting herself as one thing to her co-workers and superiors, yet living in truth a completely different life.

    She does so to protect HER interests, not theirs.

    Now, they probably don’t care what her sexual orientation is. That’s not the question. The question is, what OTHER decisions does she make on a moment to moment basis, involving what information she decides people need to know, and what needs to be concealed from them.

    This makes for a HIGHLY deceptive personality and thus unfit for duty since the people she is deceiving are those she works with most closely. She’s simply violated the trust of everyone she works with and will do so whenever she decides it’s in her best interest…….

    XL_611, I have to disagree with you. What the heck was the police doing looking through her windows? That’s a violation of her privacy. What statute/law mandates local police to report sexual orientation to the Armed Forces? That’s a federal entity. Those ducks are municipal. Armed Forces didn’t ask, she didn’t tell. Everyone was cool with it. She was doing the right thing by serving her country. See that’s what bothers me. These same officers would be dogging her out if she couldn’t make a way for herself and ended up on social services. When she did what she needed to do and became a contributor to society, the God Damned Police go waaay out of their jurisdiction and mother lovin way, to be sure she loses every thing she worked for. WHat’s the greater evil here? Who the woman loves or the forces that coluded against her because of who she loved? And you wonder why white women become terrorist?

    Jahz? What the “heck” were they doing? They were attempting to serve a warrant. It’s their job. They had a right to search. They did not break in, but did survey the exterior and what they could of the interior, no doubt to see if anyone was in there.

    They have an obligation to report whatever findings to interested parties.
