Medical authorities still have not determined the cause of death of a 20-year-old Middletown, Del. man who died after an April 26 fight, but the mother of Ty Sawyer is calling for justice in her son’s death.

Police, however, say they don’t have enough evidence to file charges against the man involved in the fight, USA Today reports.

Lisa Sawyer maintains her son was beaten to death by the man, whose name police have not yet released. Police found Sawyer unconscious at a home in the 200 block of East Bradford Court in Misty Vale Farm, the site reports. He was rushed to Christiana Hospital and pronounced dead a short time later.

“It angers me because I just want to know what happened,” Sawyer said Monday. “My son cannot speak for himself, so I will speak for him and I will make sure that this is handled properly.”

Sawyer also said the lead detective has been disrespectful to her during the most painful time in her life. “I don’t trust the New Castle County police,” she said.

Officials are still waiting for a toxicology test, which could take up to a month or longer. Sawyer’s mother has refused to bury him — USA Today reports that she might have her own autopsy performed if she is not satisfied with the medical examiner’s report.

A funeral service, however, was held for Sawyer Saturday.

County police Chief Elmer Setting said he empathizes with Sawyer but emphasized that his agency is conducting a thorough investigation in conjunction with Attorney General Matt Denn’s office. Both have agreed that at this point no charges should be filed, Setting said. “We are waiting for scientific reports but as of now we don’t have enough evidence to file charges,” Setting said.

Setting also said that five witnesses claimed Sawyer and the unnamed man were “mutual combatants.” But according to a Delaware Online report, the young man kept challenging and taunting Sawyer to fight. At one point, the man smashed the family’s mailbox.

An online petition, which has garnered nearly 5,000 signatures as of Wednesday afternoon, is calling for the arrest of Patrick Downey. Police, however, have yet to confirmed that this is the identity of the other party involved.
